how nice a chance to use his second amendment ahhhhh
liberty at work ....the people here used their rights as well
5 shootings [2] dead an equal amount of stabbings [1] dead
3 hit and runs [2] dead .. ahhhhhhhhhh the second amendment at work ..... did you ever wonder why the dead didn't have the same rights ...... guess not

Ok, so I agree he made a mistake by not calling the cops right away.

However, these two kids broke into his house several times in the past, steeling guns the last time. The cops did nothing about those instances. Nobody cared how much of his belongings they took. Nobody cared that he lived every moment of every day wondering when they would come back and now he knew they were armed. He just wanted to be left alone, but they still chose to break into his place. Not only that, they chose to go to his place after breaking into another house the same day. The first house they broke into was empty, the owner was on vacation. They took some prescription pills and left valuables at the empty home to go on to this guys house.

As far as I am concerned the guy saved us tax payers a boat-load of money. While he may not have been without fault. These two young people were headed towards a life of crime, drug abuse and welfare.

I feel for their families and his family too. Everybody here was a victim.

"Smith said he dragged Brady’s body into his workshop, then sat in a chair. When Kifer came down the stairs, he shot her too. After she fell, he tried to shoot her again but his gun jammed, and she laughed, the complaint said. Smith pulled out another gun and shot her several times in the chest, acknowledging he fired “more shots than I needed to,” the complaint said."

She laughed at him when the gun jammed after he shot her once on the stairs and she fell? That's a Darwin Award right there.(Assuming this laughing can be verified by audio or video surveillance.)

Obviously if he had "just" kneecapped them or whatever his (criminal) legal problems would be far less or maybe even non existent.

it stated one broke into the house previously ...I didn't see where he knew they were armed .never saw where they broke into a house the same day and it was mt nor left valuables . usually you take them

Disappointed,assumed a little more speculation from this crowd.
IF he would have only fired once,with a high powered weapon or at closer range & blown the INTRUDERS head clear off,would someone be saying it was to much?
IF a wild animal attacks me & I quit firing when I run out of ammunition
do I get arrested ?
Do we need to stop all intruders into or onto OUR space & ask, IF they are armed ,BEFORE we defend ourselves?
A lot of this case is similar to something i have actually heard ,local leo telling a woman after the 3rd time she had her home broken into,SHE should have just moved?

That's a fair lesson.

Another is that in most states you won't get away with using violence once it's no longer a matter of self defense. And if he's dragging bodies around after they're dead, and shooting the wounded girl once she's down, then he's shooting people after they're clearly no threat.

It will be interesting to see how the trial proceeds.

It's not that he shot them when they were down, but the way he did it and what he said about how he did it. In the case of the male, he stood over him and shot him in the face and then said "I want him dead". That statement has nothing to do with defending yourself. Especially since the intruder was down and no longer a threat. He just simply wanted to "kill" someone at that point. He further demonstrated this in the way he laid in wait for the female.(I have problems with that one. Why would she go down the stairs knowing someone was down there with a gun?) after she was down also, he calmly put the gun under her chin and blew her brains out. His statement was "it was a good 'kill' shot". That wasn't a "good kill shot". That was an execution. She was down also and no longer a threat.

The interesting part of his trial will be the audio recordings from inside the house. Another interesting thing will be the explanation of why he waited until the next day and then have the "neighbor" call the police. That only makes what he did look more suspicious. Why did he wait? And then to go upstairs and go to sleep with two dead people in your basement begs a whole new round of questions.

Right, you've laid that out well. It goes beyond the sufficient-to-charge-him fact of the victims already being down and being no threat when he shot them, to include his quite explicit statements and actions which reveal the two killings were executions.

His statements and delay in telling anyone about the bodies might help an insanity defense. They indicate he may not fully understand his own culpability.
