American Student Punished for Refusing to Recite Mexican Pledge

A Texas high school student has filed a federal lawsuit against her school and her teachers after she was punished for refusing to salute and recite the Mexican pledge of allegiance.

The Thomas More Law Center filed the suit on behalf of Brenda Brinsdon alleging the McAllen Independent School District violated the 15-year-old girl’s constitutional rights when she was forced to recite the Mexican pledge and sing the Mexican national anthem.

Brinsdon, who is the daughter of a Mexican immigrant and an American father, refused. She believed it was un-American to pledge a loyalty oath to another country.

Ironically, the school district has a policy that prohibits a school from compelling students to recite the American Pledge of Allegiance.

She was instead given a paper to write about the Mexican revolution,which received a failing mark there has yet to be a publishing of that paper so the masses can see if it was a case of bad teacher...I believe that paper should be published so we can fully judge for ourselves..until then, it's just more hyper media bs.

None of the other students were given the writing assignment, only her, because she refused to perform the oath. She even said that she would say the American pledge in Spanish, but that was not acceptable. This is a clear case of bias by the teacher.

If you take French 101 and refuse to speak French in the class - you fail. Likewise, in a Spanish class, if you refuse to speak Spanish - you fail.

"The recitation of the Mexican pledge and the singing of the Mexican national anthem was part of a 2011 Spanish class assignment at Achieve Early College High School. The teacher, Reyna Santos, required all her students to participate in the lesson."

This had nothing to do with her Constitutional rights as an American - it was part of the class curriculum. If she refuses to do this now, wait till she actually gets to college and takes Russian or Portugese.

She didn't refuse to speak Spanish, from what I gather.

They could've just as easily recited teh U.S. pledge and the U.S. national anthem is Spanish.

I was curious to see if anyone besides Fox had reported on this, so did a search. I was suprised to see that an ABC affiliated had, but it was an article from 2011.

You don't understand - it was a Spanish class - not a public speaking class. She refused to recite the Mexican pledge as part of the assignment. It's a college-prep class, not a grade school class - there isn't a lot of wiggle room for alternative assignments or methods. My guess is that she didn't study the assignment and decided to make it an issue to deflect from her shortcomings.

She approached then Principal Yvette Cavazos about her reservations and was given the alternative assignment.


After the pledge incident began garnering media attention, Cavazos pulled Brinsdon from the class, for which she later received a failing grade, according to the lawsuit.



Although she received a failing grade for the course after submitting the alternative assignment, the school eventually corrected the grade after being contacted by her parents. But Mersino, the attorney, said district administrators refused to respond to requests that its policies be addressed to avoid similar incidents in the future.

Personally, this proud Texas citizen of the United States of America would refuse to say a pledge of Allegiance to or salute another country's flag.
In any circumstance or for any reason.
Period.

I.M.O. the teacher was out of bounds.
Slapping the face of the very country that gave her employment and opportunity.

I am curious if this incident occurred at the same school where the Mexican flag was raised on the flag pole above the Up Side Down Flag of the USA.

It will be very interesting to see how this controversy plays out.

Spanish class has nothing to do with the Mexican flag or it's national anthem. Saying pledges to another national's flag or it's anthem has no place in a U.S class room, IMO.

The U.S. anthem and allegiance could have been said in Spanish.
