It's illegal to leave a firearm where children can play with it. The problem in this case is the idiot parents, kinda like the parents that let their kids ride their bikes in traffic and then are amazed that they get run over.

A five year old being given a real firearm? What are they thinking? And the style of gun involved here is definitely aimed at kids in more ways than one. It is intended as a child's first firearm. perhaps before he sticks it up you know where, he should be sure the safety isn't on.

They are still a weapon - as was the gun that kid shot his sister with. The purpose of those type of weapons is to teach kids gun safety - guns of any types are not toys. But the manufacturers still market them as such to kids.
