Think of all of the skills he can pick up in a JV center in the next 5 1/2 years. He belongs in a psych ward for the first year or two to see if he's truly an unsympathetic, inability to feel apathy - basically a true psychopath. Then he should be resentenced to JV detention accordingly. The parents should be forced into counseling as well.

The MRI studies have been misleading in a way. Yes, most/all of violent offenders have that in their MRI. However, NOT everyone who has it will become a violent offender.

I think 10 years old is too young to give up on. With a couple of years of intense therapy (ASSUMING the child cooperates which is a big assumption) a psych should be able to give a clearer diagnosis and prognosis.

Eric Smith admitted to his grandfather that he had killed Derrick several days later. Like Edward Kindt, Eric Smith was sentenced to the maximum juvenile sentence for second degree murder in New York State- only 9 years to life. He was sentenced in 1994, and in June of 2002 Smith became eligible for parole. He was denied.


If "Penny's Law" had been in place at the time of this murder, Derrick's family would still have 10-15 years before having to worry about Eric Smith being paroled; however, now they will face parole hearings every two years until the day Smith is released from prison.

If he is truly a psychopath, should not be allowed to live and I don't care how young he is. People like that need to be deleted from the mathematical equation which is society, we have far too many negative numbers running around loose as is. We need to get over the idea that human life has an intrinsic value, for certainly it does not. People make themselves worthless and less than worthless by their actions, and unless it was an accident or there are mitigating circumstances this sort of thing certainly qualifies. If he's allowed to live, he will certainly be released one day, and the people he rapes and murders and harms than will have the people to thank who failed to do, now, what should be done. If his parents don't like it, then they need to be told you shouldn't have spawned and raised a psycho.

I've some really mixed emotions about stories like this. I tend to be a strong advocate of euthanasia. On a few different levels.

Have you ever seen the movie, The Bad Seed.


I did in my youth.(no, not when it came out, but close enough) Think I was around 10 when I saw it. Something really effected me about it. Could have been living with my sister. She is cold and mean as night.

This movie and folk like my sister lead me to study human behavior over the decades.

I realize a 10 year old is hard to give up on. A child of any age is hard to give up on. But yet, not all children are good, as not all humans are good.

Your post touched me. Gave me pause to ponder. As over time I've become pretty cold toward mankind.

You know, T Turner, some times we just have to admit, this can happen.

I tend to stick to my guns, that until a certain age a human lacks a point of reference. On the other hand, am convinced that by the age of 10 a human should know right for wrong.

Rape and murder is pretty wrong. Point of reference or not.

In my world, would give the child a year to show signs of improvement, then would consider euthanasia.

My apologies to all this offends. But, I feel is the way it should be done.
