The woman was actually fired, for being, a bitch! Co-workers stated that she was cranky, sour and simply cantankerous. They also stated that she had a life size cardboard cutout of Obama that she would perform inappropriate act on in full view of the rest of the staff.

I imagine it isn't against the law because historically it's not something that folks have been discriminated on the basis of. If you look at what the protected classes are, it's usually groups of people who have historically had a problem with discrimination.
