The Boy Scouts are a private organization, very similar to a country club - they can and will be selective on who they allow into their membership. Clubs are exclusive - witness Augusta National Golf Club - no women allowed. Facebook is a public forum, very similar to Topix and other forums. As long as you agree to their terms and conditions, no one is limited to a membership. Your statement of promoting a safe environment is a little off - they actually state in their terms and conditions, "...physical harm, or a direct threat to public safety." No where in their terms and conditions is it stated that they're membership is selective other than "Organizations with a record or terrorist or violent criminal activity are not allowed to maintain a presence on our site."
Facebook is an online, non-political, social networking service.
Facebook is not a public forum, you must be a member to participate, which implies that it is in fact private.

I had to do a paper once on a case (can't remember the parties) on whether or not virtual child pornography could be regulated or if it would violate free speech since no actual children were used but were only life-like computer generated images.

INFO:
The U.S. Supreme Court, in a close 5 - 4 decision, overturned an earlier New Jersey Supreme Court ruling that had found that the Boy Scouts were a public accommodation. The U.S. Supreme Court ruled that the BSA is a private organization and thus may set its own moral code. Forcing it to accept gays would violate its constitutional right to freedom of association.

the BSA can now legally discriminate on the basis of gender, age, sexual orientation, religious belief or any other basis. They do not have to follow local, state or federal anti-discrimination laws.

I believe the Facebook falls under the same protection as the BSA when it comes to legally restricting it's membership.

But even though it is publicly traded there is an EULA to be agreed upon and a membership requirement to fulfill.
Topix allows for unregistered users to post, aka grey boxers, and still they can limit speech. To post on Facebook requires a poster to be a member and to agree to their membership standards. If those standards are modified to exclude registered sex offenders then what legal grounds do the sex offenders have to fall back on. Facebook is not a federal entity and freedom of association is only federally restricted by discrimination due to race.

Youíre adding a telephone and bus. Apples and oranges.

Facebook owns the site and servers. Essentially private property.

The burden of the second amendment is applied only to our government.

Are you suggesting I have freedom of speech inside your home? On your property?

Oh.
You clearly donít understand the US Constitution. The first amendment doesnít apply to Facebook. Then you compare that with the second amendment. You know what? The entire US Constitution is a burden on government. Which means the government may not infringe either.

On my property I can eject you for any reason. I donít like what you say and youíre gone. I donít like your religion and youíre gone. No violation of your rights. You have no right on my property. I can deny you to carry a firearm on my property but allow others.

This does indeed get more complicated when dealing with companies. If Facebook doesnít want you on the servers they can eject you for violation of their Terms of Service. They can not however deny access due to race or religion. But, if you were to annoy other by pushing your religion on others they can ban you.

Facebook in no way violates first amendment rights be denying access to sexual predators.

Wrong.
Freedom of speech is the political right to communicate one's opinions and ideas. The term freedom of expression is sometimes used synonymously, but includes any act of seeking, receiving and imparting information or ideas, regardless of the medium used.
Read: Regardless of the medium used.
The only time you give up those rights is renouncing you citizenship or you are incarcerated (which some prisoners have challenged).
Therefore, apart from certain narrow exceptions, the government normally cannot regulate the content of speech. Associate Justice Thurgood Marshall cogently explained this in 1972:
[A]bove all else, the First Amendment means that government has no power to restrict expression because of its message, its ideas, its subject matter, or its content.[Citations.] To permit the continued building of our politics and culture, and to assure self-fulfillment for each individual, our people are guaranteed the right to express any thought, free from government censorship. The essence of this forbidden censorship is content control. Any restriction on expressive activity because of its content would completely undercut the 'profound national commitment to the principle that debate on public issues should be uninhibited, robust, and wide-open.'
The first amendment does NOT apply to Facebook. The first amendment is a burden on the government.
