He will be tried as a civilian, but the state can hold of on reading him his Miranda rights under the public safety exemption. At least that is what I am hearing from the local news.

Not sure he can be considered an enemy combatant since he became a U.S. about a year ago (according to news reports). I believe I read somewhere that there is some type of provision where, if it is deemed to be in the best interest of public safety, the accused can be denied Miranda rights.
I wasn't sure how the laws was worded
when it came to American citizens vs
enemy combatants.

I hope they try him as a combatant.
That makes him eligible for the death penalty if I'm not mistaken.
It's time to play hardball with domestic terrorists.
You blow something up or shoot up a school, you need to understand that you won't survive the experience.

i'd prefer a million armed citizens to appear when they transfer him to court and take him for a good old fashioned lynching.

I'd happily witness his execution, after being found guilty of the crimes he's alleged to have committed. Explain to all of us, angry, anonymous greybox, how a "good old fashion lynching" wouldn't be as barbaric and lawless as what he and his brother allegedly did? Don't hurry! We'll wait...

lthe ways it wouldn't be as bad as what they did?

It would be a punishment for the barbaric act he committed not an act against innocent people as he chose to do.

He is not an innocent 8 years old cheering his daddy on in the race while eating ice cream.

He is not the man standing there where his brother set down the bomb by his legs after looking him in the eye. You know the one whose legs were blown off?

I could go on but when I think about more carefully I realize a simple lynching would be too good for him

"It would be a punishment for the barbaric act he committed..." Yes, a barbaric act of punishment. We're either a society of laws, or we're not. Folks who choose to be selectively, subjectively pro-law in one instance and pro-mob rule / lynch mob mentality in another make me laugh. There's no fence-sitting allowed here. You're either invested in the current judicial process or you're not. Which is it?

If he's done what he's alleged to have done, does he deserve a slow, painful execution? Absolutely! I'm thinking maybe by one or more of his hand-crafted works! So are you pro-law or pro-mob? Take your time! We'll wait...

you just contradicted yourself saying you want a slow painful execution while claiming you are pro law.

You know that isn't legal, the law doesn't allow for anything considered cruel or unusual for criminals no matter how much they do to the innocent ones

I'm tired of all the violence against innocent people so yeah I feel like its time for so violence against the criminals.

It's how I feel and if you notice I was sarcastic in my responses to you about your opinion as you are being toward my expressing my feelings.

Our current legal system is working in cases like this one

"The FBI confirmed that in 2011, it probed Tsarnaev's older brother, Tamerlan, for possible extremist ties after a tip from a foreign country that he was a "follower of radical Islam" and planned to join an underground group. Agents grilled him and neighbors and did not find "any terrorism activity, domestic or foreign."

They couldn't touch him under our current laws until him maimed and killed.
