I understand that the NBA is a privately owned company that has its own "constitution" which the players, coaches, and owners have agreed to operate under.

But would the NBA be allowed to use their status as a private company and their "constitution" to oust a owner based on his sexual preference or would the government step in to stop it?

What will the NBA do going forward when a player ( black or white ) is recorded making racist comments? Won't they be required to hand down the same punishment? What if the player is Lebron James? Are we to believe that Lebron or any other top NBA players have NEVER made a racist comment? Is Sterling's penalty really appropriate for what he said or is the NBA coming down so hard on him because they can do so without suffering any financial loss?

I don't disagree with the action taken against Sterling but the NBA could be setting a precedence here that they may have trouble living by in the future.
If they choose not to hand out a life-time ban to anyone caught making a racist statement going forward they will certainly open themselves up for a descrimination suite.

LoL.

Coming from a guy who trys to blame his hateful posts on others, that's hilarious.

I also do not disagree with the penalty handed down to Sterling. However, I believe the NBA has already shown that their policies only apply to a certain few by continuing to not only employee Spike Lee on it's radio network, but allowing him front row access to the commissioner's press conference.

If you support the decision to ban Sterling for life then you must be prepared to support the same penalty if Lebron James is some day recorded telling his girlfriend not to post pictures online of her with a white guy. If you didnt support a life-time ban of Lebron under those circumstances then your opinion could be viewed as racist.

At the very least it could be argued that Sterling was discriminated against if ever there is anyone in the NBA who doesnt receive a life-time ban after making racist comments.

Again, I don't disagree with Sterling's penalty but I believe this decision will come back a haunt the NBA when someone who is well liked by fans is caught making the same type of comments that Sterling made.

The standard NBA contract has a code of conduct clause or 20 that is not unlike the owners'. I see what you like to do - you like to disagree on the tiniest of facts in order to be wholly right about something so trivial to feel good about yourself - but what he says has merit. If the boardroom at NBA HQs wants to fry a guy for this then it better take a long hard look at what these playas start mumbling.

wrong you are trying two different cases here the players union has a great legal power .. stay on the one case.... Sterling didn't legally do a damn thing
to the NBA by-laws he did ..they the NBA will be the only ones who enforce their law ........ players union will enforce their law ..now which one do you want to argue BARRISTER

see if this helps ya ..........

Bylaws are rules that lay down the internal rules of a corporation.....bylaws typically state the rights, duties and liabilities of the members of the corporation, as well as the rules relating to transferring and selling shares. Bylaws will also typically discuss the roles of the [Board of Directors and corporate officers of a corporation.]....bylaws are usually enacted by the initial Board of Directors or the incorporator(s) of the corporation and may be amended from time to time by the Board of Directors.
