WEBSTER SPRINGS -- Webster County authorities have charged a Webster Springs woman with murdering her husband.

Prosecutor Dwayne Vandevender says Julia Surbaugh shot and killed her husband Michael last Thursday.
It happened at about 7:30 a.m. at the couple's home.

Surbaugh was booked in the Central Regional Jail, Wednesday morning and is charged with first degree murder.

Authorities have not released a motive in the case.

Michael Surbaugh was a former science teacher at Webster County High School.

The state police arrested him last May, after they found 14 grams of marijuana, various prescription drugs, a loaded .22 caliber pistol, and several knives in his car.

Btw, they got the date wrong. Mike was born in 1960, not 1966. He was 49 years and 15 days old.

RIP MIKE

While in the hospital, Mike gave a statement before he died. He said that he woke up and felt like someone had hit him in the head with a baseball bat and Julie, his wife, was standing over him with a gun.

Sorry for her? I am sorry for us, who listened to her lies at the funeral. I am sorry for us, who watched her act like a grieving widow. I am sorry for us, who have to deal with the pain she caused. I am sorry for Mike. I am sorry for his children. I am sorry for his family. I'm even sorry for her prison roommate, who will have to put up with her. Divorce is the answer for cheating, not gunfire.

THANK YOU, Time for the Truth!

Julie's story has shifted gears throughout this past week. Little changes that she hasn't been able to keep straight while re-telling her version of the story. Her main story has been that he tried to kill her, she knocked the gun away, and then he said, "Well, if that's the way it's going to be, then I'll just kill myself," and apparently then put the gun to his own head. Then she said he FELL on the gun. Then she said they were cuddling on the bed together when he just went pyscho and there was a struggle.

WHY were there 3-4 gun shots? WHY did he call his girlfriend and say he was going to be late b/c someone just shot him? He had PLANS that afternoon! This man LOVED life, LOVED Mother Nature, LOVED the community life and volunteering. He was not suicidal. Mike was an alcoholic and pot smoker all his adult life, and yes, Julie knew. It was just a shocker to the public b/c it was caught on school grounds. He's ALWAYS had knives and guns on him for protection, but answer if you've witnessed him EVER using them as a weapon?! The only times people I've spoken to have seen him use a knife is to carve pumpkins, cut rope, and cut duck tape. And why didn't they just go ahead and get a divorce since that's apparently why the whole fight started anyway--Mike wanted a divorce and to be with his girlfriend. Mike was previously divorced so we all know he wasn't anti-divorce. If she hadn't murdered him and just divorced him, Julie, who so loves her sons, would be able to see them without being behind bars in an orange jumpsuit and being responsible for their father's death! And just to note, Mike has 4 kids, ages 26, 20, 10, and 7. She took the life of a father of FOUR! He was ONLY 49! JUST turned 49!

I, too, am very offended by her fakeness and sobs of pity-me when the whole thing was premeditated! I heard she took care of ALL of the debt they had last week, and probably has life insurance money she expected to get away with, too. Her motive is obvious--she was cheated on and didn't want her sons having a stepmother, didn't want to go through a potentially messy divorce at the age of 47, and had the train of thought, "Well, if I can't have him, no one will!" I'm sure there were other motives, like the insurance money and whatever she got from his Will, but I for one definitely think it was premeditated, and I've spoken to several others who feel the same way.

Gavin and Rigel are with their Godparents, who are the next door neighbors. They didn't see their mom get arrested and did get to say good-bye to her--the police let her not have hand cuffs on to hug them goodbye.

What I want to know is what are the dates for her trials? Will she be out again this week when she posts bail? First Degree Murder in WV is a life sentence (they don't have the death penalty in WV--which I don't think she deserves anyway) but she can get out before the life sentence completes its term, such as if she does a deal and pleads guilty for a lesser sentence, or if the jury/judge gives her mercy. I don't think it's healthy or right to have a woman on the streets who JUST got arrested for First Degree Murder by killing her husband b/c he wanted a divorce.

I for one do not think that Gavin and Rigel are going to be better off with a "mom" who murdered their father in his sleep. Thank God for their wonderful Godparents and other family members who love them and are watching out for them, not to mention the neighbors and friends of Mike.

PLEASE post more if you know more!

Thursday
Mike was shot twice in the head and was alert to the point of talking to the EMTs and hospital staff. He died when he was intubated and placed on the HealthNet helicopter of a cardiac arrest. Apparently, Julie's two shots to his head hit him just under the brain, but slightly grazed his windpipe, causing his lungs and internal organs to slowly fill with blood. Julie repeatedly changed her story, then on Wednesday morning, she entered the police station and told the police, "Yeah, I killed him." She is now charged with First Degree Murder, which is premeditated.

What a slow, horrible death! And she admitted to it!

Yet, here in little Webster Springs she'll be here again tomorrow on house arrest. Her bond hearing was today, and they set it for $80,000. This sickens me to no end. She should not be released. She should not be able to post bond, which is only 10% which is only $8,000. She has lost physical custody of the boys temporarily, but she'll be able to visit them in her home, have whoever else she wants over, unlimited access to TV, radio, phone, internet, etc. She'll be able to take long bubble baths, won't have to follow any kind of schedule, and will sit at home on home arrest until her trial, which could be months, or could be YEARS! And get this--she is ALLOWED to go back and forth to WORK! What in the world?!?!? I could throw up! SHE ADMITTED to shooting him!

She still claims self-defense, but that's just a joke. He was ASLEEP! Why didn't she have any marks or bruises on her? All I saw was a bandaid on her toe--no bruises on her arms or wrists or face, etc. If she wanted to do self-defense, all she had to do was shoot him in the leg, run away to the neighbors, lock the door, and call 911. Self-defense my ass. I'm not that dumb.

She also gets EVERYTHING at this point--motive. House, cars, boats--that can add up to quite a bit. She still says there was no will and no life insurance, but sources say that may very well end up being a lie too.

What else does everyone know at this point in time? Keep posting--we've got to get to the bottom of this. Webster Springs doesn't need a Murderer walking around. The coroner (however it's spelled) KNOWS it was murder and very inconsistent with her stories. Gun residue and finger prints and other evidence all prove she IS guilty. She needs to stay locked up!

Why wasn't he flown out? He should have been! All he got was abulance rides and hospital stays. Why didn't anyone drive him to the hospital? They could have gotten him to a hospital faster than the abulance got there--the hospital is just half a mile away! They could have gotten him faster attention and to an ambulance to go elsewhere even faster. He didn't have the weapon on him--it was in the laundry basket. He was hurt, she wasn't.

ANYONE WHO IS INTERESTED IN THE FULLER TRUE STORY, PLEASE GO TO THE WEBSTER COUNTY COURT HOUSE AND REQUEST TO SEE THE PUBLIC RECORDS FOR SURBAUGH. Civil, County, and Magistrate Court Records will show you the truth. Go to the Magistrate Clerk Office right beside the Webster County Court House in Webster Springs, WV (right where Julie lives in Hotel Bottom, btw). You can view them for free, or get any public document copied for yourself for pocket change--literally.

Saddened in Princeton, what about MIKE??? You HOPE it was self-defense or SOMETHING? I mean, what in the world, you HOPE MIKE was a brutal, vicious man who deserved to be murdered? He wasn't drunk or high at 7-7:30 in the morning--he wasn't even awake when she shot him! He'd been having an affair for a year+(I really don't know anything about his affair) and that came out to the public in May, and she said she's known longer, so that's not it. Julie has been charged with First Degree Murder because there is plenty of evidence that it was PREMEDITATED.

Now, Saddened, I full-hearedly agree with your statement, "Just Don't Do Drugs, People!" but that isn't the reason this murder happened, so it was kinda a little off base here....And I agree, SO TERRIBLE for ALL of his FOUR kids, Jared, Kiera, Gavin and Rigel. I do NOT pity Julie. I pity the regret the whole community is going to have to face when she kills herself b/c she can't be on suicide watch while on House Arrest like she can be in a prison, and who's to say she isn't going to kill herself and Gavin and Rigel so they can "all be together without worry." People DO do this. I went to school with a boy who's father killed his mother and baby brother and then commited suicide for this very same reason. She wanted a divorce, he didn't, so he killed them all so they could all be together, in his sick mind. The boy I went to school with only lived because he did not go home that day. The mother had a restraining order on the father for stalking, and he still came. She would do this b/c she can so I hope to God that the boys are not EVER left alone for a SECOND (which would be illegal to anyways--she has to have supervised visitation at all times) but Gavin and Rigel are able to spend the night with her starting tonight, just as long as there is at least one person of the age of eighteen or older and of stable mind is in their presence with her. So what happens when they're all sleeping?

What about MIKE??? I miss him. I cry for HIM. NOT Julie, the Murderer. She's ONLY out b/c the grand Jury only meets a few times a year. September is the next chance to get in, but that's only like 3 weeks away--not enough time to prepare a full murder trial. The next chance the Grand Jury is meeting is in January, which might be the month she goes away to prison for Life (with or without mercy), or it could be in May 2010 if her attorney keeps pushing the date, or the prosecutor NEEDS more time. I for one hope it's tried in January. I am SOOO scared for Gavin and Rigel. If she had been putting them FIRST like a mother is supposed to, then she would have just divorced Mike, not shot him three times in the head while he was in bed sleeping. She didn't even have to worry about him getting custody, not with the alcoholism and drug arrests. He would have had supervised visitation, just like she has right now. But he would have never murdered anyone.

HAS ANYONE EVER SEEN MIKE EVEN KILL A BUG? I know he went deer hunting, but I have never known of him to actually kill a deer, or even shoot at one. He's just gone up to drink, hang out with buddies, play cards and fart into the wind. He taught all four of his children to respect Mother Nature full-heartedly and to NEVER kill anything unless you A) absolutely had to--otherwise shoot in the foot and run B) to survive for food and shelter/warmth purposes. He did not believe in killing for fun. He did not believe in killing. So, sorry, but that ticks me off that people are, "Oh, POOR Julie!" POOR MIKE! Remember, the DEAD one--the one who never got to meet any grandkids! The one who was ONLY 49 years and 15 days old! The one who will NEVER get another Christmas with his family--but oh, Julie will!

This is so sad. Mr. Surbaugh was an awesome teacher. I remember when he was my eighth grade teacher. He was always really nice to me. My heart just absolutely breaks for his children. I remember Gavin when he was just a toddler and boy did he ever love his daddy. Do the kids need anything? I hope and pray that there is justice. I can't imagine what they are going through. Can you please keep an update of how they are doing and if not I understand.I know they need their space. My heart and prayers are with them.

Just a thought, I don't think anyone in Webster has to worry about Julie walking the streets: meaning she is not a threat to anyone else. However, every married woman with a half decent husband should grab him and run when she sees Janet "THE SLUT" Morton coming toward them because she will do anything and everything to get what she wants.

Julie murdered him, not Janet. She shouldn't be out of prison--she murdered Mike, premeditated, admitted to it, evidence proves she did it. So just let her go on living in the home she murdered him with 24/7 access to her family and friends, although Mike will NEVER EVER get this opportunity again?!? W-H-A-T? She also has 24/7 access to internet, phone, lawyer, relaxation, and can go to work full-time out of home. That's not the legal system doing their job. Who else other than Julia Surbaugh (Howell) has ever gotten to post bond in the state of WV for First Degree Murder?

Corruption!

Did you read all of the posts? How about the post from the Magistrate Court?

Get over yourself. This situation is a complete tragedy for everyone. If you are concerned about corruption make some complaints. Judges can't just pick and choose who they let out they follow guidelines. Based on personal experience I know that Janet would sleep with her husband's best friend or her best friend's husband which ever was closer.

Whatever happened to "innocent until proven guilty"? No one knows what goes on behind closed doors, and it's so easy for one to jump to conclusions when rumors are flying high. Were you people in the house the morning of the shooting? Did you personally speak to Mike or Julie before, during, or afterward? I am seriously doubting it. This is the problem with small town gossip, everyone thinks they know all there is to know about everyone else's business but their own! Let me tell you something, if your little rumors are true about the affair (let me stress "RUMORS"), then I doubt if I could convict Julie if I was sitting on the jury. If she did just snap, one couldn't blame her (again, assuming the rumors are true). If she planned it and confessed, then why did she just stop at him? I would have gotten 2 birds with one stone, wouldn't you? All I'm saying is that there are ALOT of unanswered questions that are not for us to decide on this God-for-saken website.
