A judge gave a celebrity-studded Central Park West co-op the green light to evict kooky, chain-smoking transgender heiress Diane Wells in a ruling issued Monday in Manhattan Supreme Court.

Transgender or not! Ya can't get away with owing the landlord $230,000 in back rent/maintenance. I wouldn't evict her, I'd imprison her! She's a deadbeat. I hope they sweat her for the money and get every nickel!

She owes NOTHING in back rent. She lives in a CONDO. She does not have a landlord. She does owe for maintenance fees, fines, and legal fees. Since she did not appear in court, a default judgement was entered against her. She did appeal and the eviction order is on hold. Likely her condo will be sold at some point in the future. The sale will net millions of dollars. That is more than enough to pay the maintenance fees and any fines and legal fees the court decides that she actually owes and still leave plenty left over.

The real issue here is that she smokes. Smokers need to understand that we do not want to have to smell tobacco smoke just so they can engage in an addiction.

So, instead of one type of bigotry, you express a different one. I'm guessing you probably wear perfume of some sort, do you know how noxious that is to a lot of people? Not to mention it's just as likely to cause allergic reactions to some people with just the odor itself. Should us allergy sufferers have the right to get perfume wearers evicted too? What about cars, they put out most noxious fumes, chemicals into the ground that go into the water source, and cause more deaths than guns in the US. We should ban them as well, it would clean up the environment and make the streets a lot safer. All technology gives off what is considered harmful radiation, should we ban anyone from using phones, computers, televisions, even refrigerators just because some people are more sensitive to the radiation and get cancer from it?

Seriously, your phobia of smokers is just as bad and ill-conceived as homophobia, it's just a different type of bigotry. Now, smokers are technically a minority as well. What's really messed up is that marijuana smokers are just as phobic of tobacco smokers, perhaps more so.

It is not a phobia about smokers. I do not fear smokers. They are nothing more than a bunch of disgusting addicts who want the whole world to "enjoy" the source of their addiction. BTW, I do not smoke pot and I do not wear perfume. I do not need to wear perfume since I do not smoke and therefore do not smell like asz.

How can you evict someone from something that they own? And on the very weak and questionable excuse that she has a habit that they don't like. Smoking is still a legal pastime!

That's still poor justification for your hatred. Your analogy is also very flawed, considering that the incontinent cannot be evicted for such things.

You're mixing apples and oranges! Your analogy is flawed! The only thing that they have in common is the fact that they're both barely legal. That still doesn't explain just how they can supercede his legal rights as an owner. The definition of Fee simple ownership means that one has the right to quiet enjoyment of her property, and it is her property! She has paid some consideration for her rights as owner. Smoking in one's home is a legal pastime. And it is her home!

When your actions in your own unit cause damage to another's unit, you can be held liable for those damages. More and more courts are ruling against smokers in cases where the smoke transfers between one unit to the next. Municipal governments are also getting into the picture and making it illegal to smoke in multiple family housing units. More and more condo associations are doing this as well. Now that second hand smoke is recognized as a health hazard, you will see this become norm.
