I'm from New York, and for a very long time, the LAW in New York has been that ANYONE can use ANY bathroom they wish, no matter how they're dressed. That's the LAW.

And women are allowed by LAW to be bare-breasted in public. That's the LAW.

Of course that is not an answer. Since we're talking about str8 males there will be a lot of jerks abusing these sorts of laws unless the law prevents such abuses in some way.

That is not an answer as long as the rules say that a student determines his or her own gender identity. You understand how laws or rules need to be specific, don't you?

There appear to be no safeguards here.

Everyone likes to pretend to be daft when the point is nettlesome in some way.

The parents could merely point to any rule saying that students determine their own gender identity and therefore which locker room or bathroom to use. They could sue the school for any action taken against their child or against themselves. And we know that fundies "court" this sort of drama.

Also, many school administrators are bigots themselves. They might like to have a court test of such regulations regarding gender identity.

It would seem obvious to most thinking persons that this eventually should be considered and accounted for in the rules. "Oh, it will take care of itself because the str8 boys are jerks" is not an answer.
