If I remember correctly, the SCOTUS has said that the scouts are a private organization, and can exclude anyone they wish. I don't have a problem with that. I do have a problem with them getting tax exemptions, public money, or other subsidies such as use of public property with no charge or reduced charge. If they want to discriminate, they should do it on their own dime.

The headline is more than a little misleading, the bill will end tax breaks and subsidies for ANY non-profit which have policies that discriminate on the basis of race, nationality, religious belief or affiliation, gender identity or sexual orientation. The Boy Scouts may have painted the best target on themselves here, but the law applies to every private organization that wishes to operate as a non-profit.

Let's see, non-profit organizations get out of paying their share of sales taxes (on their purchases and on what we buy from them), most property taxes, income taxes on donations, capital gains taxes on proceeds from investments and that's just off the top of my head. A lot of these groups also get direct government grants and breaks on the fees for the use of publicly owned facilities. I doubt that even the BSA would be able to survive in California without that safety net, I'm not real sure there is ANY non-profit that could.
