An Arizona man who garnered national media attention for giving birth to three children after having a sex-change operation has hit a snag in his divorce proceedings that could prevent him from having his marriage legally dissolved.

Our gender, regardless of the one one chooses, is still a part of one's legal identity and since there are widely different standards of who gets to call themselves male and who gets to call themselves female, it becomes important pretty much any time you get involved with the various levels of government. take this case for example, if Thomas Beattie is legally male he is legally married, if he is not, she is not, at least not in Nevada. That's why I said that this circus could be an important one, because it has the potential of leveling the playing field for those who are transgendered.

You don't see a problem with there even being a legal issue about it? Why should gender matter in legal marriage?

There is only one reason a government would care what gender a person is, either to oppress one or the other, or to tell people what they have to do and think based on it. Other than that, there is no valid reason they should care. It's all a socially accepted form of stupid.

Gender should not matter in marriage, but we still have a situation in many states where it does, a lot. Like it or not, classifications based on legal gender exist. Whether it is different physical standards for males and females in certain jobs like the military, police, firefighting or the reality that co-ed prisons are few and far between; the reality that one state can say you are male and another can say you are female, no matter what you have to say on the subject, is a problem that needs to be resolved.

We are still at a point in time where it does matter and whether you like it or not, in some ways always will. There will always be some parts of the law which differentiate between who is legally male and who is legally female, so it's about time we have a consistent answer as to who can be which.

The marriage was made when he was legally female then that is what applies to the marriage, and the divorce.

Under the law at the time they were married, Beattie had to be legally male, but under current Arizona law he wasn't male unless there had been a completed equipment change.

This case also asks the question of whether full faith and credit constitutional guarantees apply to marriages and not just divorce. Can one state simply declare another state's marriage null and void just because it crossed state lines?
