178 Anonymous Online Topix Posters Sued

There are 20 comments on the www.ucdailynews.com story from Mar 10, 2010, titled 178 Anonymous Online Topix Posters Sued . In it, www.ucdailynews.com reports that:

Topix said that if the line has been crossed and it seems reasonable, Topix will cooperate with the courts.

The authors of comments on the Topix.com Web site were secure in believing they were anonymous, however, a judge ruled their names should be revealed.

"Topix, for its part, appears to be doing its best to ensure that it only hands over exactly what is required, and not a bit more. Topix CEO Chris Tolles told Computerworld that the company takes privacy very seriously, and that the company would not "simply hand over all of our records" without reviewing the subpoena in detail. "We prefer to make sure requests are clear and specific and not overly broad," he said. According to the order, Topix has until March 6 to give up the information."

Internet companies can't just hand over records . Quasi news is still news and Topix itself has first amendment protections .

I would not hand personal info over without proper legal documents and then depending on the circumstances might take a contempt charge .

This is a fine line we walk with our precious first amendment . The internet did not exist when it was written .

Be nice , be ready to prove what you say and you will have no worries .

I agree but the courts involved can interpret this to reveal the names and even if overturned you won't get your name un-revaeled .

This is what the lawsuit is about . Trolls got revealed then got trolled mercilessly . Ironic kind of justice .

"The Leshers said it basically made them both feel like common criminals.

The Leshers said it made them feel as though someone had raped them of their reputation and standing in the community over and over and over again."

How did the comments rape them of their reputations and standing in the community? Since it happened over and over again, should'nt that article have said "The Leshers said it made them feel as though someone had gang-raped them of their reputation and standing in the community?" What passes for journalism in the country today...

"Mark and Rhonda Lesher lives in Northeast Texas; Mark practices law and Rhonda runs a beauty salon."

He was a lawyer and the first amendment was violated 178 times by the lower court.

Still what is key here is the identities of the posters was revealed and could not be un-revealed .

Personally I am ambivalent about the issue but would error on the side of protecting the first amendment .

The first amendment was placed first intentionally .

That was over a year ago. Wonder if the posters' identities were revealed?

A deputy in White Co tried to get the identities of topix posters revealed, and he failed. He lost his job over some issue with the supponeas, and the identities were never relvealed.

That's right. People can say whatever they want if it's the truth not a darn thing anybody can do about it. Plus did u notice it said the guy was an attorney. No attorney would waste their time on a case like this anyway. That person that keeps bringing this up on all the pages is just mad because somebody is telling the truth about them. I personally believe it is Vern crabtree or dr airfart.

The issue was that he did not go through the court system to do it, that's all. As for the Leshers not being current, yes it is still current and the court ruled that topix had to reveal the identification and they had until March 6, 2010 to do it and then one more week was added to that deadline by the Leshers, not topix. You just have to look and all this info. is given on your computer

Now I understand the reason why multiple nasty thread, wich the majority are made by anonymous posters are not been deleted. I send my feedback at least 4 times and topix will not care. It's so sad that everything is about money. I can't afford to pay $19.99 for a nasty thread to be deleted. There is a lot of them (see link below).

I believe he was able to sue at least one person over the ordeal. I could be wrong but i'm sure a rhonda got sued

what about people who post point blank lies just to hurt someone. can anything be done if their posts can proven untrue. also what is the exact difinition slander and how does this work?

Slander is a malicious, false, and defamatory statement. Whereas libel is doing it in written form; mainly where it is open to public view. And, both are illegal. I think Topix is a great forum for news, opinions and discussions, yet the anonymity provided to people who do use it to slander and libel people is pretty sad. For those who are so afraid to speak their minds and put their names to it, perhaps they should keep their mouths shut. It would seem intelligent adults who want to spread their opinions publicly should have backbone enough to do so. In my own experience with Topix, after being libeled by a couple (Francine Griego and Paul Fellows), Topix has been hugely helpful (without paying any fees)in providing the information needed to legally protect myself.(of course, having a good attorney helps...).
Nasty, mean comments - while uncomfortable and ugly, are protected by freedom of speech laws. But, when they are complete lies, they are illegal and there should be a means to stop it.

yeah, it was SETTLED when the fired the deputy and then SETTLED again when he petioned to get his job back and the city council refused to give it to him... the unsolved murder that sparked the former cops attempt to illegally obtain the names of the topix posters is still unsolved.

Immigration is a hot button subject. Someone disagreed with you and trolled you.

Yours is one of the worst cases I have seen and that troll is stalking you from forum to forum .
