Freedom of Speech. Just hope it keeps the truth going. There is a lot of shit that is true would not be brought up if someone had to use their name. There are plenty of things that need to be brought up and no one should have to use their name. The Big shit heads that dont want people to know what is going on is the ones that an end to topix. People stand up for the Truth and let people expose things that needs exposing.

Thats my thing, she won the election, is still married( which if a topix thread ended your marriage... Well, it might have been doing a person a favor).... What was she out? What suffering had it cost her, from a legal standpoint?

Not sure anything can be proven harmful. It was gossip but what happens when the "named" person says "I heard it from blah blah"... Does it keep going down the chain of hearsay?
Like someone else posted, how they going to prove who posted... If from work computer or family computer then there would be multiple suspects. Consider wireless routers, I pick up my neighbors...

Like I have stated... I don't think I could support her next election. Not because what the thread said, i knew more than likely it was bullshat because it was on topix...but how she has reacted to the thread. Just my humble opinion.

My father once told me: "You can never underestimate the (American) public."

One minute reading Topix posts proves him right.

You go, Sarah. I support you all the way!

Lies and more lies I once read on here that I would try to introduce more controls on guns and some even said I would try to take guns away from citizens. Of course there is no truth to that.
But I do want stronger background checks on gun purchasers.( of course I don't like background checks on Presidential candidates )

Praise Allah (who? me I ain't no Muslim.Would I lie about it?)

Way to go Ms. Davis glad you are standing up for what is right. As we all know, you cannot do wrong and get by with it. The mean, jealous bloggers WILL always be payed back in some form. In my opinion, posting lies on someone is alot more than gossiping. Good people stand up and be heard!!!

Two aspects of the case appear a bit sensationalistic.

I totally don't believe the lawyers claim that his posts were auto-deleted one minute after posting. Sounds like a typical lawyer tactic to infer that he and his client are "being picked on" once again, this time by the owner of a big bad website.

The other thing I don't believe is the assertion on her part that comments posted on here can be marriage-ending, and how lucky she is that her husband was "understanding". I don't know about you, but if comments were posted on this site about me having sex, my spouse would just get a good laugh, not sue for divorce. As would the majority of others.

As a public official, she has a higher burden of proof for libel. She has to prove specific intent to do damage rather than simply go after someone who brain-farted a slanderous comment all over their keyboard.

Sounds to me she isn't trying to win, but rather uncloak the poster for her personal knowledge and send a "chill" through the forum here. And there is plenty wrong with any public figure who thinks its their job to intimidate the public into biting their tongue.

I never knew his lady, never heard of her, never heard of this cry baby. To be honest this is what Politics is all about, if she cant take the shit talking then you dont need to be in politics. All this does is make her look weak and definatley not the type of person that can go everyday and ignore the gossip, when in that position you have to be able to ignore all the gossip and keep your head up and go on with your life, thats a good politician, yet most of the lie so i dont know what good that is but alteast they are following the correct morale that is expected of a politician. you didnt hear Bill clinton whine and cry about the lewinsky ordeal, he just sucked it up and eventually admitted to it. oh well, and people still like him. I personally would not ever vote for someone who makes these kind of lawsuits, It shows no back bone.

I live in Clarksville, Tx and the ones you are talking about did haul them into court. Awarded a 13 million dollar judgement and it was overturned by another judge. So the Plaintiffs got nothing but huge legal bills. They already knew who was doing it but did get the ip's identified through court order.
Those people gave up their home/ranch, a million dollars and counting all just to sue people on topix and LOSE the lawsuit. This is very crazy, they were rich, they were millionaires who didnt have to worry about anything yet they got on topix and got mad over rumors and threw it all away. I hope that lesson hits the hearts of all the rich folk with too much money and too much time on their hands.

How it Ended

Her lawyer told her she had a great case, and then proceeded to bill her for every hour, every phone call, every letter, all which she had to pay for.

Topix, receiving a warrant, turned over the ip address of the poster.

Since most ISPs in the area use dynamic address allocation, this ip address likely led to a dead end.

Even if it could have been tied to a specific household at the time, many people use wifi in their houses and don't set a password, thus anyone in their neighborhood could have posted it.

It's almost impossible to tie these things to a specific person unless one is very fortunate, such as the person posted from work, they don't have wifi there, and they said specific enough things to identify themselves.

Without these factors, launching such a law suit just gets you a bunch of legal bills.

But what about the lawyer saying there is a case? That is what lawyers say. They say you have a case, and then they bill you for every minute they work, rounding UP to the next quarter hour for each 2 minute phone call.
