Transgendered students in California will now have the right to use whichever bathrooms they prefer and join either the boys or girls sports teams, thanks to landmark legislation signed by Democratic Gov. Jerry Brown on Monday.
The law amends the states education code, and stipulates that each student will have access to facilities, sports teams, and programs that are consistent with his or her gender identity, rather than the students actual biological composition. A male student who self-identifies as female could therefore use the girls bathroom, even if he is anatomically male.
Though the debate over accommodating transgendered students needs has ramped up recently with several high-profile cases attracting media scrutiny California is the first state to address the issue with statewide legal action.
Im so excited that California is making sure transgender students have a fair chance to graduate and succeed, said Calen Valencia, an 18-year-old transgender student, in a statement. I should have graduated this year, but my school refused to give me the same opportunity to succeed as other boys. Now other transgender youth wont have to choose between being themselves and graduating high school.
The legislation was sponsored by Democratic Assemblyman Tom Ammiano, who said that it will make school life easier for transgendered kids.
A spokesperson for Ammiano admitted that the bill would irk some parents who do not want their kids sharing bathrooms with members of the opposite sex. BUT WHO GIVES A DAMMM WHAT PARENTS WANT, says the DNP, its about protecting and making things easier for confused kids to graduate so that they can persue their useful purposes in life such as cosmetology, or fashion design, you know, careers that look down on transgenders without high school diplomas!
Clearly, there are some parents who are not going to like it, said Carlos Alcala, a spokesperson for Ammiano, in a statement to San Jose Mercury News. We are hopeful school districts will work with them so no students are put in an uncomfortable position.

MONTEGO BAY, Jamaica Dwayne Jones was relentlessly teased in high school for being effeminate until he dropped out. His father not only kicked him out of the house at the age of 14 but also helped jeering neighbors push the youngster from the rough Jamaican slum where he grew up.
By age 16, the teenager was dead beaten, stabbed, shot and run over by a car when he showed up at a street party dressed as a woman. His mistake: confiding to a friend that he was attending a "straight" party as a girl for the first time in his life.
"When I saw Dwayne's body, I started shaking and crying," said Khloe, one of three transgender friends who shared a derelict house with the teenager in the hills above the north coast city of Montego Bay. Like many transgender and gay people in Jamaica, Khloe wouldn't give a full name out of fear.
"It was horrible. It was so, so painful to see him like that."
International advocacy groups often portray this Caribbean island as the most hostile country in the Western Hemisphere for gay and transgender people. After two prominent gay rights activists were murdered, a researcher with the U.S.-based Human Rights Watch in 2006 called the environment in Jamaica for such groups "the worst any of us has ever seen."

The U.S. Court of Appeals for the D.C. Circuit has ordered the Nuclear Regulatory Commission to resume the license application process for the Yucca Mountain nuclear waste facility.
The ruling of a divided three-judge panel presents a setback for the Obama administration and Sen. Harry Reid (D-Nev.) both of whom worked aggressively to kill the facility.
The Department of Energy submitted its licensing application for Yucca Mountain to the commission in 2008. In January 2010, PRESIDENT OBUMBLE directed then U.S. Department of Energy Secretary Steven Chu to scuttle plans for the Yucca facility.
Soon thereafter, states and counties stuck storing the waste, as well as and individuals affected by the temporary storage facilities, filed multiple lawsuits to try and reignite the licensing process. Plaintiffs argued that the commission was bound by the Nuclear Waste Policy Act to consider the Yucca Mountain application. Among the objections of the commission was the lack of full funding, which it blamed on Congress.(The NRC has $11.1 million in its coffers specifically for the licensing process.)
The court had previously threatened the use of a writ of mandamus unless the commission restored the application process or Congress enacted a law to terminate the process. The lack of inactivity from both Congress and the commission pushed the hand of the court.
Writing for the majority, Judge Brett Kavanaugh admonished the commission for "flouting the law."
He was joined by Judge A. Raymond Randolph, while Judge Merrick Garland dissented.
"The Nuclear Regulatory Commission has declined to continue the statutorily mandated Yucca Mountain licensing process," Kavanaugh wrote. "Several justifications have been suggested in support of the Commissions actions in this case. None is persuasive."
K&L Gates partners Barry Hartman and Tim Peckinpaugh represent three plaintiffs from Washington state who lived near the temporary sites.
"This case was clearly a policy dispute, and the commission walked away from the law because it was told to do so," Harman said in an interview. "If you don't like it, change the law."
Aside from the implications regarding licensing, Kavanaugh wrote that there are serious implications in the use of executive power.
Kavanaugh wrote: "It is no overstatement to say that our constitutional system of separation of powers would be significantly altered if we were to allow executive and independent agencies to disregard federal law in the manner asserted in this case by the Nuclear Regulatory Commission. Our decision today rests on the constitutional authority of Congress, and the respect that the Executive and the Judiciary properly owe to Congress in the circumstances here."
In response to the ruling, Reid today told reporters at an energy summit press conference in Las Vegas that since there is no money appropriated the Yucca Mountain facitily would not proceed, according to a transcript provided by Reid's office.
"There is no money, weve cut funding for many years now and there is none in the pipeline, so this is just a bump in the road, without being disrespectful to the Court it means nothing," Reid said.
Lets say it again francis...It is no overstatement to say that our constitutional system of separation of powers would be significantly altered if we were to allow executive agencies to disregard federal law...imagine that?

James Bamford reveals some shocking facts in his latest book The Shadow Factory, of which the most innocent allegations are those of wiretapping and violating the privacy of Americans.

Bamford talked about his latest book The Shadow Factory with military reservist and former sergeant of the military intelligence service Adrienne Kinne and navy linguist David Murfee Faulk, two very unpopular people inside the NSA recently. They warned of disputed activities of that branch of the American government.

So you actually think republicans are evil? Maybe not so much evil but they are liars and manipulators - why would they assume that everyone that votes is cheating or is voting illegally? If they want a National ID fine, instead of penalizing college kids and the elder African Americans with their pseudo voter ID? It just happens to be the voter block that votes mostly democrat how convenient! It wasn't so long ago that the republicans tried the same crap with blacks making them pass a test and pay a tax to vote. A national ID is really pretty simple: It's just a way of identifying people. I wont stop terrorism or stop identity theft. But it would be a way for employers to make sure they hire only legal residents. It would be handy for the poor and the unbanked who don't have ready access to secure ID as they wont go away anytime soon, unless the t-bagers have their way by interning them. It might even make emergency medicine easier if it allowed more reliable access to digital medical records.

So why was there no evidence of these engines against the wall of the Pentagon? The two big holes that we would expect to see are not there. There should have been a line of complete destruction before the collapse of the buildings external wall. Its simply not there. Instead, where the wings of the aircraft should have struck the building, in cooperation with the mighty engines, there are unbroken windows clearly visible.
