No one said it's a constitutional right. It's not health crap, it's that someone smoking infringes upon me to not want to smell like it IN A PUBLIC PLACE. It's not a private campfire.....you miss it if you think it's about health.....it's about being considerate and polite in a civil society.....and by the way you're ignoring the fact that it's illegal whether you like it or not.....it's illegal

Yeah, a real man expresses how he feels by violence. Great idea. Thinking like this is what makes problems worse...how does punching one idiot smoking in the bathroom in the nose stop others from smoking in the bathroom. Great plan.

It's sort of incredible how an issue expands. Syler leads off by complaining that people are smoking in a public indoor area. Pretty soon, we have the constitution brought into the argument and Spector is decrying Syler's manhood. Makes sense...

Anyway, I think the heart of the issue is that the bathroom is indoors, confined, and public. Smoking outside with a little breeze is one thing, but a crowded room is something else. The idea that the existing security (Not a special task force made up of the religious right) stop by the restrooms and clear out the smokers doesn't seem like much of a hassle or a stretch to me.

Or have I missed something here?

I was waiting for one of the smokers to say that the father had the choice whether or not to take the kid into a bathroom. Then someone wonders whether or not a baseball game is the right place for a 5 year-old. Put the cancer sticks down and enjoy the game. What do you need them for?

If some reasonable accomodation were made to allow the smokers to light up outside, I sincerely doubt they'd be hanging around the men's room.

Prohibition doesn't work for anything.

I am a non-smoker, but feel the smokers' rights have not been accommodated adequately, lately. There's no good reason there cannot be some bars with smoking liquor licenses and the rest with non-smoking licenses. Similarly, there's no reason Wrigley cannot have several conveniently-located outdoor smoking areas and, if need be, re-entry privileges if a smoker needs to leave the ballpark to use them.

The ANTI-smokers (different from non-smokers) seem to want to create situations that make things as uncomfortable as possible for smokers for periods that are as lengthy as possible. Their intent is not to protect non-smokers from secondhand smoke in these situations. Rather it is to inflict distress on the smokers.

The ANTI-smokers are the bullies of this decade.

What you have missed is the question of "Where can you smoke?" If smokers are not given a place to smoke, they will find a place -- in this instance, the lavatories.
