Here's the information that I have about whether Burke may or may not be a suspect. The first comes from Colorado Human Services, the child protection agency. It was mandatory that they interview Burke and they did so in early January. That's when they wrote their report where they said "It is clear from his interview that Burke did not see his sister, JonBenet's, death. That then leaves the question for those who theorize Burke hit JonBenet with a hammer, there is a disagreement between your theory and that of Colorado Human Services and their Child Protection Team. You can decide who you think is right. Good question.
Had Burke struck JB with the flashlight and she was not bleeding but merely "passed out" at the time, he probably would not have thought she was dead. Children equate blood with death and injury. I imagine he was sent to his room upon Patsy being informed of the argument and the fact that his sister was not waking up now. He would not have been witness to the cover-up and staging. So, in his mind, she was not dead when he left her.

The problem with this theory is that Burke was interviewed by a detective at the White's and he only thought Jonbenet was missing. Never ever thought she had been killed. Then he was interviewed by a police psychiatrist who deemed him safe to return to his parents. Had the psychiatrist been suspicious whatsoever he would not have been returned to his parents---whether they thought John or Patsy were the killers of if Burke killed her accidentally. The goal is to close the case. True he could have have been sent to prison but that doesn't mean he couldn't be deemed as the killer so the case could be closed. But they never found any reason for that. Burke was cleared early on.
