Former District Attorney Alex Hunter and Smika’s attorneys agreed, in writing, that the grand jury convened to investigate the case would not indict Smika. They also agreed that Smika’s mother and sister would not be called as witnesses.
In exchange, Smika’s attorney allowed his client to remain in police custody, even though no charges were formally filed against him.
The deal didn’t make any sense if Hunter was sincerely trying to solve a homicide, Menger said.
“To me it was rather strange that he did that,” Menger said.

Didn't Robert Redford get involved with that? I seem to recall his anger over the Boulder DA as well, but I could be wrong..

OMG, this is HUGE! The Boulder DA's office has FINALLY sought a MURDER WARRANT IN THE BIGGEST HOMICIDE CASE SINCE JONBENET RAMSEY, THE SID WELLS CASE. Both Hunter and Lacy were to GUTLESS to go after this man, in fact, Alex Hunter, in one of his sleazy deals, PROMISED THE DEFENDANT HE WOULD NOT BE INDICTED BY THE GRAND JURY. Sound familiar? It's a new day in Boulder! Thank GOD for Stan Garnett.

This gives us hope that the JB case still has a chance of being solved. Especially combining this info with the news a while back that investigators had sought out Burke for a further statement on the case.

I would venture a guess that there would have been no letter to the Ramseys which was illegal and inappropriate and as L_E said, he certainly couldn't have done worse

Trip DeMuth would have been a disaster, worse than Lacy! He was the main guy for the intruder's theory under Hunter in the DA's office, always refusing the police routine search warrants, etc. He immediately went to work for JOHN RAMSEY'S LAWYER, Mike Bynum, as soon as he lost the DA's race.

This is a GREAT article on this case, AND IT'S MEANING FOR THE RAMSEY CASE. When I first came on this case, YOU HAD to learn about the Sid Wells case, since the two cases were SO ALIKE. Now, the WONDERFUL DA has cleared the deck of ALL OTHER unsolved BIG homicide cases, BUT RAMSEY. Ramsey gets all the attention now, and this DA WANTS the Ramsey case solved:

Great post and great article, Candy! You had the same thought I had when I learned about the arrest warrant, i.e., that now the detectives who worked on the Wells' case can be freed up to devote more officers and time to the JB case!

I wonder what is contained in the affidavit? Do you have access to it or can you get it? It just might prove interesting.

Also, perhaps this line in the article is a clue to the BPD's recent invitation to BR to come in and talk to them: "Over the past decade Boulder PD has issued statements that they wanted to talk to Smika."

Absolutely right. He helped Smit put that "crockumentary" together as well.

John Walsh has an excellent new show on CNN Sundays at 9 called "The Hunt," that profiles the worst of the worst fugitives on the run. THANK GOD, Walsh has on his webpage, a case BPD has LONG, LONG asked Walsh to run: The Sid Wells/ Thayne Smika case. Hopefully, they will feature it on his show. I pray they catch this creep, "The Hunt" AMW is the perfect venue, all that's needed is someone to see the age progressed picture and someone close to that in real life. Please pray for Justice for Sid Wells and that someone spots Smika and turns him in. Sid Wells parents have done everything and more to help law enforcment catch this creep. Scroll down:

In January 1983, Sid Wells, a 22-year&#8208;old journalism student at the University of Colorado at Boulder, posted an ad for a room for rent. Seven months later, he was dead – shot in the back of the head, execution-style. The chief suspect: his new roommate, Thayne Smika, a 24-year-old college dropout from Akron, Colorado. Wells allegedly had trouble collecting the rent from Smika, and authorities believe the roommates were arguing over the late rent payment shortly before Wells was killed inside the apartment. Police arrested Smika on October 6, 1983, but prosecutors declined to charge him with the killing, saying there wasn’t enough evidence. Boulder police reopened the case in 1997 and, with the FBI’s help, established new forensic and ballistic evidence linking Smika to the murder. A warrant for Smika’s arrest was issued in 2011, but he has yet to be located. Boulder police believe he may have a new identity, and his family may be helping him. Recent information indicates he may be living near Puerto Vallarta, Mexico. The case attracted the attention of the national media because Wells was dating Robert Redford’s daughter at the time he was killed.
