Garnett hands apparent indictment to judge

Boulder District Attorney Stan Garnett has turned over what is believed to be a 1999 grand-jury indictment in the JonBenet Ramsey case to a judge, who will now decide whether to disclose the documents.

Garnett offered to file under seal "any such document in our possession" in a response to a ruling this week in the lawsuit brought by Daily Camera reporter Charlie Brennan and the Reporters Committee for Freedom of the Press seeking the release of the unprosecuted indictment of John and Patsy Ramsey on charges relating to their 6-year-old daughter's death.

On Monday, retired Weld County Judge Robert Lowenbach ordered the District Attorney's Office to "file any requested document under seal."

The judge is expected to review the documents to determine if they can be released.

Thank you so much Heloise for bringing this here.

I am desperately trying not to get overly hopeful about the results of this but there is a part of me that will remain excited regardless LOL

I'm expecting that the judge, after his review will hear arguments from both sides of the issue, now that we know John is in a panic, so I don't think this decision will come about too soon

I agree Caps. I admit that I am struggling to contain my excitement. Charlie Brennan tweeted this while I was monitoring something else. Can't actually remember now what I was originally looking for...

As you say, this could drag on for weeks. It will be a hard sell for John to persuade the judge that the indictment's contents will affect public perception given that he isn't supposed to know its contents! But I am picturing lots of expensive lawyers working hard to find other arguments.

This could turn out to be the defining test of Lacy's BS "exoneration of nothing" letter.

Since Haddon is arguing that the remaining relatives of the victim, JonBenet, by law have standing to be heard in such decisions regarding the case, he pulled out that stupid Lacy letter as some kind of factor in not excluding the Ramseys from having their argument for not releasing the True Bill carry weight.

But if the Ramseys are still suspects (and how can they not be), that's like putting the fox in charge of the henhouse. The document in question is IN FACT an INDICTMENT OF THEIR INVOLVEMENT.

There has been no arrest or trial or conviction in this case. No matter how many lies Lacy told in 2008 about alleged TDNA on the child's clothing proving the killer was an intruder, she is on the record herself stating it could be artifact and may not have anything to do with the murder at all. She even said NO SANE DA WOULD EVER CLEAR ANYONE IN AN OPEN CASE.(See her mea culpa press conference when she released Karr with no charges.)

It's the moment of truth for Boulder.

Pardon me if I expect the same old same old, flip flop cover up, to-hell-with-the-truth.

Well stated KK. I have to admit that I am expecting the Ramsey Apologists to come up with some 11th hour success preventing the indictment from being unsealed. In light of the Press coverage fawning all over Alex Hunter after it was revealed that he refused to prosecute this case, nothing--regardless how outrageous and damming-- that accrues to the Ramseys benefit surprises me any more.

Well, we are talking about lawyers after all. It's not like there's going to be any illusion of fighting the good fight in that group. They'd as soon sell their own children to the Devil as do the right thing, if the price is right, IMO.

I have this image in my mind of Haddon sidling up to old Judge Lowenbach, grinning like Beelzebub in a 3-piece tailored suit, black eyes twinkling, pitchfork tail twitching while throwing his considerable influence and weight around, name-dropping, insinuating there are connections to be made, deals to be struck, souls to be bartered....

After 17 years of watching how this always goes down in Boulder, I'm expecting the worst.

But I hope I'm wrong.
