Let's start in Boulder with the Midyette case. Neither rotten parent would flip on the other, a grand jury indicted both, and Molly's trial was first. Just like in the Joseph Dowler case, investigation showed the father to be the violent bully, and the mother the indifferent enabler. She claimed the housewife "I don't know" what happened defense, as to how her baby sustained 37 broken bones in her and her husband's custody, plus numerous other injuries that ended his life after only 10 weeks alive. It technically WAS NOT a classic cross finger pointing defense, she said she didn't believe Alex caused the injuries either, BUT her lawyer in closing arguments, pointing the blame straight at Alex. IT DIDN'T WORK. Thanks to Molly taking the stand in her own defense NO ONE BELIEVED HER, and a bunch of impeachment came in against her. The jury threw the book at her, convicting her of the maximium charge. Now behind bars, she WANTS to pull a battered woman's defense, except she wasn't battered, she's now a convicted felon and no one is going to believe her in his trial. So he benefitted from her refusal to take a deal until it was too late. He DID NOT take the stand in his own trial, moved to Denver, after his violent outburst upon Molly's conviction. Because Molly could not testify against him, they could only get in rough housing testimony, and he was convicted of the LESSER charge.
In the Ricky Holland case, once again, neither parent would flip on the other, until, nearly a year after Ricky's "disappearance", Tim called 911 on Lisa, saying she tried to kill him by throwing a plugged in hair dryer into the shower when he was taking a shower. They BOTH immediately pointed at each other. Tim received a deal to tell law enforement where Ricky's body was and testify against Lisa. In that case, it was believed Lisa was the violent parent, and Tim the indifferent enabler. Tim testified against Lisa. THE JURY DID NOT BELIEVE HIS TESTIMONY, but they convicted Lisa of first degree murder, despite not believing Tim's testimony, and despite her lawyer blaming the murder on Tim. Bottom line is: A JURY WILL DISTRUST BOTH PARENTS IN WHICH A CHILD ENDED UP DEAD IN THE HOUSE. Cross finger pointing really doesn't work.
