Wendy Murphy mentioned this in her book as one reason prosecutors may not have wanted to indict the case. The nighmare scenerio is John and Patsy are indicted, each blames the other, the jury believes the other party is culpable, each gets off separately. IN FACT, let's look at two cases LIKE the Ramsey case of ALLEGED parental homicide where that defense DID NOT WORK.

Let's start in Boulder with the Midyette case. Neither rotten parent would flip on the other, a grand jury indicted both, and Molly's trial was first. Just like in the Joseph Dowler case, investigation showed the father to be the violent bully, and the mother the indifferent enabler. She claimed the housewife "I don't know" what happened defense, as to how her baby sustained 37 broken bones in her and her husband's custody, plus numerous other injuries that ended his life after only 10 weeks alive. It technically WAS NOT a classic cross finger pointing defense, she said she didn't believe Alex caused the injuries either, BUT her lawyer in closing arguments, pointing the blame straight at Alex. IT DIDN'T WORK. Thanks to Molly taking the stand in her own defense NO ONE BELIEVED HER, and a bunch of impeachment came in against her. The jury threw the book at her, convicting her of the maximium charge. Now behind bars, she WANTS to pull a battered woman's defense, except she wasn't battered, she's now a convicted felon and no one is going to believe her in his trial. So he benefitted from her refusal to take a deal until it was too late. He DID NOT take the stand in his own trial, moved to Denver, after his violent outburst upon Molly's conviction. Because Molly could not testify against him, they could only get in rough housing testimony, and he was convicted of the LESSER charge.

In the Ricky Holland case, once again, neither parent would flip on the other, until, nearly a year after Ricky's "disappearance", Tim called 911 on Lisa, saying she tried to kill him by throwing a plugged in hair dryer into the shower when he was taking a shower. They BOTH immediately pointed at each other. Tim received a deal to tell law enforement where Ricky's body was and testify against Lisa. In that case, it was believed Lisa was the violent parent, and Tim the indifferent enabler. Tim testified against Lisa. THE JURY DID NOT BELIEVE HIS TESTIMONY, but they convicted Lisa of first degree murder, despite not believing Tim's testimony, and despite her lawyer blaming the murder on Tim. Bottom line is: A JURY WILL DISTRUST BOTH PARENTS IN WHICH A CHILD ENDED UP DEAD IN THE HOUSE. Cross finger pointing really doesn't work.

I would guess that this scenerio played itself out in the grand jury also. A locked home, two parents at home, and a dead kid found in the home the next day. The grand jury held BOTH accountable for child abuse leading to death, not just one.

Truthfully, in THIS case, cross finger pointing would work

Unless they have indisputable evidence of what each family member did and did not do, they cannot convict either or both of the parents of a murder.

I don't know what evidence the GJ based their child abuse charges on, and perhaps they may have been able to convict on a child abuse charge, but the cross finger pointing in the murder case would have kept them both out of prison

Noody knows exactly who did what in the house that night

Burke and John Ramsey know who did what and why Jonbenet is dead. My money is on Burke causing the head injury, John strangling her and Patsy writing the note with input from John.

The party at the Whites included appetizers of leftover Christmas Eve seafood and mini hotdogs in BBQ sauce, said to be a favorite with his kids by John Ramsey. The main meal was a classic sit down dinner of turkey with all the trimmings.

If brought to court the case is far easier to prosecute now that Patsy has died. Burke is no longer a child and no longer offered all the prtection he once was. He still can't be prosecuted but John can.

That family's dysfunction was a time bomb ticking away under the kitchen table. Burke was as mentally ill as a child can be - he didn't defecate in the toilet.

It's all about Burke and always will be.

There isn't any evidence Patsy ever read your favorite bedtime story. She saw the movie and memorized a few lines for the talent portion of a pageant.

Don't you have some tax forms to fill out?
