It says that the fraudulent illegal cannot be charged with an EXTRA two years in jail.

It does NOT stop them from being punished by law in any other way.

What utter nonsense...an illegal who uses falsified or stolen documents KNOWS that they are not his/hers! This is not a victimless crime in too many cases. How about looking out for Americans' best interests instead of pandering to these losers who lack scruples and the intestinal fortitude to do things the legal way.

The two years would have been if he had been found guilty of ID theft and the verdict was allowed to stand. He is just charged with being in the county illegally. That is the only charges that can be filed against him. This decision opens the door for any one, citizen or not to just steal someones ID and not have a worry in the world. They will just say, I did not know who's ss this was.
He'll just get deported while the persons life that he wrecked gets to stay behind and clean it up.
Yes, do read the story. It says his conviction was overturned.

You have to wonder about decisions that make it easier to pick and choose when they will allow "ignorance" of the law as a defense.
