Yes, it was an abuse of power by the judge but mostly the fault of Gray Davis for not pursuing the appeal. We got even by kicking him out of office with a recall vote but it was too late.

This argument about state’s economic impact has been addressed in previous Supreme Court decisions.
In Graham v. Richardson, 403 U.S. 365 (1971)., Supreme Court held that a state’s regulations conditioning the receipt of welfare benefits either on U.S. citizenship or residence within the United States for a specified number of years failed to meet the intermediate scrutiny test, even though, the state argued it was justified due to limited public resources.
In Plyler v. Doe, 457 U.S. 202 (1982), the Supreme Court held that a state’s
refusal to finance the education of undocumented children failed to meet the intermediate scrutiny test; even though, the state argued that educating these children would drain the state’s revenues.
As such, it would appear that ballot measure suffers from the same defect as prior cases before the Supreme Court if the state’s only argument is an economic one.
Things have changed since those cases you cited (1971 & 1982). California can now prove without a doubt that it is suffering because of these services. I think the measure stands a good chance given the current economic crisis.
