CASE CLOSED:
"The right to vote, before this amendment to the constitution, was wholly granted or denied and regulated by the several states of the Union; and now the citizens of these United States have granted and guaranteed by national authority that which before they enjoyed--if enjoyed at all--at the will of the local or state governments. To make available the right to vote to all citizens of the United States without regard to race, color, or previous condition of servitude was the direct purpose of the fifteenth amendment. We cannot see therefore, how legislation which has this purpose directly in view cannot be appropriate because it was not directed against some denial or infringement by general or state legislation. The mode of the assertion of the constitutional right to vote in the fifteenth amendment is not altogether a novel feature in our constitution as has been remarked on a former occasion during the trial of this cause. "The privilege of the writ of habeas corpus shall not be suspended unless, when in cases of rebellion or invasion, the public safety may require it." Section 9, art. 1, par. 2. This clause comprehends the constitutional grant of the writ of habeas corpus under the form of an expression of denial of its suspension except in certain cases. Article 1st of the amendment to the constitution, is in these words: "Congress shall make no law respecting an establishment of religion or prohibiting the free exercise thereof, or abridging the freedom of speech; or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances." In this article it will be observed that the right to full liberty of religious faith, as regards any attempt to control it by the general government, secured to the citizen by the constitution of the United States, is granted under a form of expression, forbidding congress to make any law "prohibiting the free exercise thereof;" and that the right to a free press and free speech are granted under a form of expression denying their abridgment. So also with the right of the people to assemble and petition the government for a redress of grievances. Article 2d of the amendment is in these words: "A well regulated militia being necessary to the security of a free state, the right of the people to keep and bear arms shall not be infringed." This constitutional right to keep and bear arms, is thus conferred by the declaration that it shall not be "infringed."--Judge Edward Green Bradford, UNITED STATES v. GIVEN,[17 Int. Rev. Rec. 195.] Circuit Court. D. Delaware. 1873. Civil Rights--Violation BY State Officer--Powers of Congress.
We plan to re-open your case, and ask for leniency.

"My excellent friend from Boylston,(Mr. Whitney,) has uttered, in the speech he has just made, many noble sentiments of love among men and peace on earth. I love peace not less ardently than my friend from Boylston. The bloodless victories of peace are as dear to me as to him. But I am not one of those men who cry peace, when there is no peace without slavery, injustice and wrong. My friend from North Brookfield,(Mr Walker,) and others, have spoken of the peace movements in England and on the continent, and of Richard Cobden and others of its leading spirits. I may be in error, but I have sometimes thought that the song which the peace movement has hymned into the ear of Europe during the past five years has made far easier the march of the legions Russia and Austria upon Hungary and Italy, and the march of the legions of France--of apostate republican France--upon Rome. While the people have listened with softened hearts to the songs of peace, their masters have disarmed them, and sent forth their increasing standing armies to crush every manifestation of freedom, progress, and popular rights. When tyranny is overthrown and freedom established; when standing armies are disbanded and the people armed for their own protection against arbitrary power; then I would write "peace" on the banners of the people and send them forth to make the tour of the world. My motto is "Liberty first--peace afterwards."

Nothing and no one is above the law. The only "absolute" right is to do whatever you want that is within the law.
Glad you brought up that point:

"The Right of the People to Keep and Bear Arms shall NOT be infringed".

U.S. Constitution:

Article. V.

"The Congress, whenever two thirds of both Houses shall deem it necessary, shall propose Amendments to this Constitution, or, on the Application of the Legislatures of two thirds of the several States, shall call a Convention for proposing Amendments, which, in either Case, shall be VALID to ALL INTENTS and PURPOSES, as PART of THIS CONSTITUTION, when ratified by the Legislatures of three fourths of the several States, or by Conventions in three fourths thereof, as the one or the other Mode of Ratification may be proposed by the Congress; Provided that no Amendment which may be made prior to the Year One thousand eight hundred and eight shall in any Manner affect the first and fourth Clauses in the Ninth Section of the first Article; and that no State, without its Consent, shall be deprived of its equal Suffrage in the Senate.

Article. VI.

"This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land; and the Judges in EVERY State shall be bound thereby, any Thing in the Constitution or Laws of ANY State to the Contrary NOTWITHSTANDING.

"The Senators and Representatives before mentioned, AND the Members of the several State Legislatures, and ALL executive and judicial Officers, BOTH of the United States and of the several States, shall be BOUND by Oath or Affirmation, to support this Constitution; but no religious Test shall ever be required as a Qualification to any Office or public Trust under the United States."

Article. VII.

"The Ratification of the Conventions of nine States, shall be sufficient for the Establishment of this Constitution between the States so ratifying the Same."

"The Right of the People to Keep and Bear Arms shall NOT be infringed".

And THAT is actual FACT.

"Also, the conditions and circumstances of the period require a finding that while the stated purpose of the right to arms was to secure a well-regulated militia, the right to self-defense was assumed by the Framers."--Chief Justice John Marshall, U.S. Supreme Court.[As quoted in Nunn v. State, 1 Ga. 243, 251 (1846); State v. Dawson, 272 N.C. 535, 159 S.E.2d 1, 9 (1968).]

And the commerce clause has ZERO effect on a Constitutionally SECURED right:

"An amendment of the constitution is of still higher authority, for it has the effect of controlling and repealing the express provisions of the constitution authorizing a power to be exercised, by a declaration that it shall not be construed to give such power. 3 Dall 382.

"We have stated to you the various provisions of the constitution of the United States and its amendments, as well as that of this state; you see their authority and obligation to be supreme over any laws or regulations which are repugnant to them, or which violate, infringe or impair any right thereby secured; the conclusions which result are too obvious to be more than stated."

The Constitution is a little more then a historical document. It is the law of the land. Democrats might not like it, but there is not a damn thing they can do about it. It is the very law they swear to uphold when they take office, not that vowing to follow a law means anything to a liberal. They have no morals.
