Families of Hospitalized Man & Arrested Partner Come Forward

The families of two men, one of whom was turned out of his partner's hospital room, in clear violation of U.S. Department of Health and Human Services visitation rules, and who was later arrested for clashing with the staff over his power of attorney for his sick partner, have gone public with their own versions of the night in question.

The obvious aspect of this story that doesn't get addressed is, if Roger was made to leave because of the 'loud' arguing, why was Lee Mansell not also arrested and ordered to leave at the same time?

I don't know what the facts are surrounding that question, but I do wonder why the point isn't raised at all in any of the articles I've read.

Obviously the answer is BECAUSE HE"S GAY! HATE CRIME!

I've been following this story since it first came out and oh my how the details of the story are not only being filled in with FACTS - but those facts are showing a few things:
1) The brother who called 911 didn't call his brother's partner, NOR did he tell the 1st responders about the fact his brother's partner had power of attorney.
2) The daughter of the gay couple pleaded with the 1st responders to await the arrival of the partner - they ignored it (with the urging of the brother)
3) The partner IN the hospital told his brother and the nurse that he wanted his partner there!
4) There was a copy of the power of attorney ON FILE and should have been referenced WHEN the patient was admitted!
5) Hospital security and the NURSE have been VERY quiet about their versions of the incident - why? One doesn't need to be a brain surgeon to figure out that neither the nurse nor security had ANY intention of heeding the wishes of the patient OR checking the LEGAL documentation. They should have diffused the situation (ie: take both men out of the room) and determined the next course of action that way!

We've NOT heard the last of this - there is LOTS of fault to go around and NONE of it falls to the gay couple or their daughter.

I agree with everything else you've said. But regardless of the actual circumstances, the hospital's lawyers and administrators would have advised the nurses and EMT's not to talk to press or anyone else. One of the frustrations of institutions that have been accused is that they have to keep quiet while the accuser is pretty much free to say whatever they want.

The eyewitness reports of the daughter are pretty damning here. But even if they're in the right, I would expect the hospital to say nothing without their lawyers present.

Whenever you contact a lawyer, the first thing they tell you is not to talk to anyone yourself. This enables the lawyer to do all the work and get paid for it. It also stops you from saying anything that can be used against you. If you refute the charges against you with personal information about the accuser, you'll end up with a second lawsuit on your hands.

Well, my partner had back surgery at a KS hospital yesterday and I had no problem. It was Menorah Med Center. My name was on all of his paper work. Emer. contact etc.

The problem originated because another family member chose to make trouble. And a homophobic nurse decided to abet the brother and not the husband.

I'm sure your family gave the staff no opportunity to put their homophobia on display. But you're unlikely to run across that at any hospital, anyway. I am optimistic enough to believe that the actions of this one nurse do not reflect the attitudes and policies of her employer.

What is a shame is that the administrators are circling the wagons rather than taking action to rectify the damage she's caused.
