Since america has always allowed the elderly and infertile to marry, it's a legally-moot theory.

It’s a long-debated political question, one that surfaced in Tuesday’s Supreme Court hearing on California’s gay marriage ban, known as Proposition 8.
Justice Sonia Sotomayor brought it up while questioning former U.S. Solicitor General Ted Olson, a Republican who argued that gay marriage is an individual right and should be protected by the Constitution.
"If you say that marriage is a fundamental right, what state restrictions could ever exist?" Sotomayor asked before referencing polygamy and incest among adults.
Sure she brought up fundamental rights. It is the central issue.

and there other methods in which to expand a family, besides the married couple having sex. you are aware of this, aren't you?

I'm not saying you 'have' to reproduce to marry...but I am saying that marriage is an institution designed for setting up a family (that included biological children)...do you disagree???

Twelve states already agree that SSM is legitimate. California will soon be number 13. France just became one more country with SSM. Looks like a growing number of people disagree with your position.
