From the story: "A federal appeals court could hold oral arguments as soon as March. A ruling there could affect all states within the court's jurisdiction: Utah, Colorado, Wyoming, New Mexico, Oklahoma, and Kansas."

Oh, please, please, please, please, please! The irony of Oklahoma being forced into recognition of gay marriage because of Utah would be priceless!

The big question is will the FEDERAL govt recognize the 1000+ marriages already performed?

More taxpayer money will be wasted on a losing battle. If it weren't for the fact that the taxpayers are all from Utah, mostly Mormon and have spent huge amounts in other states to deny us our rights, I would actually feel bad for them. As it is, a bit of schadenfreude is slipping into my thinking.

And as Tom said above, "Let the lawsuits begin."

And think what fun it would be to watch Sally Kern's head explode.

I TOTALLY agree with ya.......let the lawsuits begin because those marriages that have been performed and the licenses returned to the County Clerk's office are legal and binding!!!!

Worst case scenario- we lose the appeal at the 10th, and/or the SCOTUS takes the case and rules a state has the right to define marriage as 1 man- 1 woman.

Best case scenario- the SCOTUS declares a right to marry nationwide for same-sex couples.

The LIKELY result will be something in between the two.

Even the worst case scenario is not the end of the road, it will just make the journey longer. The demographics favor us in the long term. So whether it's in 5 years or 50 years, same-sex couples WILL have the right to marry in every state eventually.

I'm still betting on a SCOTUS decision before the end of the decade; maybe from a different SCOTUS than today.

I agree. How much did the Mormon church spend on Prop 8? Add this projected $2 million cost to that. Maybe they'll run out of money eventually.

And don't forget all the money they threw into the fight in Hawaii at the start of this battle in 1998.

I agree with ya.......we will end up probably somewhere in between or we might just get Utah, but NOT the rest of the 10th!!!

I seriously DON'T see this taking another 50 years!!!

I just thought of an interesting question that someone in a different part of the country might be able to answer: if the federal appeals issued a ruling that would impact Kansas, what happens in Kansas City, which straddles two states (Kansas and Missouri) and is under the jurisdiction of two different federal courts?

Kansas City does NOT straddle 2 states....You have Kansas City, KS ---in KANSAS. Then Kansas City, MISSOURI.

I'm not sure how we could get Utah without the rest of the 10th circuit considering the district court's ruling, but I guess it's possible. I'd be more than happy to get just Utah; that would lay the groundwork for the remaining 32 states.

Win or lose in Utah, it's back to the ballot box in '14 (Oregon) & '16 (CO, MI, OH, NV, AZ). Assuming we don't get the "big win" from the SCOTUS in the meantime, the hardest part will be even getting a proposal on the ballot in states without an initiative/referendum process. Those states are mostly solid GOP controlled legislatures, and will of course block any new vote on the issue. That's THE main reason those states put their bans in their constitution in the first place; they KNEW just how hard it would be to overturn them.

Perhaps now is the time for an emergency petition to the US Supreme Court to have the stay repealed since the UTAH KKK is abusing it
.

Thanks. I drove up there for the very first time late last month to get a cashier's check from Wells Fargo Bank, and kept crossing back and forth between the two states without realizing it ... it was a little confusing, and it never occurred to me that I was also weaving in and out of two separate cities with two separate municipal governments.

You have to realize that in my corner of the state, one zip code covers not only the city, and a couple of separate townships and villages, but a large swath of the county as well. A dissimilar set of circumstances applies in Dallas-Fort Worth in which two disconnected land masses might be one city, under the same government, but divided by an independent town or series of towns. Go figure!
