Interesting case. ANd notice that the author of teh article cites the "Full Faith and Credit" clause as I have s often done here countless times.....

Well, 99% of tehn people whopost here constantly insist I am wrong for citing that clause, when I argue that once a single state granted us equal marriage rights, ALL states must legally recognize that. About 99% of teh peopel here insist I am WRONG on that. I say they are WRONG.

The Prosecutor can not compel the spouse to testify against her spouse.....communication is protected between them!!!

Let me mention an analogy to this case.

About 1/2 the states allow the marriage of first cousins. About 1/2 half the states do NOT allow the marriage of first cousins. But ALL states legally recognize the marriages of first cousins performed in other states where it is legal, EVEN THOUGH their law forbids it.

Now, KENTUCKY IS ONE OF THOSE STATES THAT DOES NOT ALLOW THE MARRIAGE OF FIRST COUSINS. But Kentucky DOES legally recognize the marriages of first cousins married in another state that allows it.

Now supposing the couple in question here was NOT a lesbian couple, but rather a heterosexual couple that happened to be first cousins (or DOUBLE first cousins), would Kentucky be making the same argument ???

THAT'S when it will get interesting.

I've been waiting for a case like this since the first Legal samesex Marriages. It's horrible that it's in a murder case, but this one aspect of it will be HUGELY important to our cause, AND will involve the FF&C clause of the U.S. Constitution. It will go Federal in mere minutes after she is Found in Contempt of Court.

I wouldn't be the least surprised if there will be Attorneys adjunct to the Case who will be camped out on the doorstep of the Federal District Court for that Jurisdiction just waiting for the call on their cellies to File a Petition for a Restraining Order pending Appeal.

That Judge's gavel will barely have time to hit the pylon before the countervailing Order is hotboxed over, a copy Filed with the pertinent Court Clerk, and the original Served to the Judge right on the Bench.

I totally agree with ya.......and it is unfortunate that it is an alleged murder case(from what I read, it could be a self defense case) but either way, it will test the FFC and Equal Protection Amendment as well.......I believe this will help our fight regarding marriages being treated the same regardless of gender make-up across the US!!!
