DOJ Set to Fight Gay-Marriage Bans in Supreme Court

I'm on a local Arkansas thread where one guy is going on about how much adding a SS spouse will raise his healthcare premiums. So I asked why he wasn't upset that people with children were also part of employer healthcare packages..

Did anyone think they'd see the day when the DOJ is supporting us in our fight for equality?

I'm still amazed at how quickly this has all turned around.

We're living through historic events on par with previous civil rights battles our parents & grandparents & great grandparents witnessed.

Holder said he believes banning same-sex marriage is unconstitutional, and he's confident the nation's highest court will agree.

SCOTUS already agrees by upholding lower court decisions.

Everything depends on how quickly the other circuit appeals courts make their rulings, and if there are any conflicting rulings. The SCOTUS is in no hurry to take another marriage case right now; they will simply put all lower court rulings on hold until at least 2 or 3 more appeals courts issue their rulings late this year or early next year.

Bottom line, don't look for any resolution until Jun 2015 at the earliest.

It is amazing. The religious fanatics brought so much attention to the cause it actually moved the whole process forward by several years.

And the 7th circuit has fast-tracked the cases in Indiana & Wisconsin with oral arguments 13 Aug.

That should give us rulings from the 6th & 7th circuits by Oct.

Assuming one of those conservative dominated appeals courts actually upholds the state bans, that sets up the conflicting rulings necessary to ensure the SCOTUS takes a case for the coming term.

For once I find myself actually hoping we lose, just to speed things up.

I'd like my marriage to be recognized in my own state by my 30th anniversary.

Given that, so far, not a single advocate of polygamous marriage has put forward even the most rudimentary template of how US marital law could accommodate polygamous marriage, I'd say you're probably right. Should someone get off their lazy duff and make a serious effort, then it just might happen.

Remember: Same-sex marriage has been half-a-century in the planning.

There is no legitimate legal reason for them to uphold bans. Your wish is a total crap shoot. Assuming they had a valid reason, then so would SCOTUS.

"If the Supreme Court agrees to hear any of those cases, the Justice Department will file a brief with the court that "will be in support of same-sex marriage," Holder said in a rare interview, sitting down with ABC News' Pierre Thomas. "

DOJ is prepared to file a brief if SCOTUS decides to hear any of the cases.

My prediction is SCOTUS will not do so for obvious political reasons.
