Apparently Scalia also doesn't think legal precedents should be applied to minorities as well.

"The very purpose of a Bill of Rights was to withdraw certain subjects from the vicissitudes of political controversy, to place them beyond the reach of majorities and officials and to establish them as legal principles to be applied by the courts. One's right to life, liberty, and property, to free speech, a free press, freedom of worship and assembly, and other fundamental rights may not be submitted to vote; they depend on the outcome of no elections."

That's essentially what he's saying- that gays & lesbians & women & blacks & jews & Asians etc etc etc have NO civil rights unless the straight white Christian male majority specifically votes to grant those groups civil rights.

According to Scalia the ONLY people which the constitution specifically grants civil rights to are straight white Christian men. All others must ask their permission first.

Normally I would agree with you, but unfortunately Scalia will never step down from the court. Our only hope is that he dies sooner rather than later.

Although an alternative would be for Kennedy to retire (more likely) and be replaced by a liberal/progressive justice, thus flipping the court to a solid liberal/progressive majority. That way Scalia would suffer by always being on the losing side.

Some state legislatures provided equal rights protections covering sexual orientation because the courts failed to DO THEIR JOB and uphold the US constitution's equal protection.

Why bother having equal protection in the US constitution if it doesn't mean anything and requires a vote of the majority to actually enforce it?

No, Scalia believes the constitution's equal rights protections ONLY apply AFTER a majority has voted to extend those protections to any group or individual other than straight white Christian men.

Having to first get permission from straight white christian men is HARDLY equal protection.
