Obama urges Supreme Court to overturn California same-sex marriage ban

no, i'm explaining the precedence set by the federal entities (SCOTUS and Congress) that can dictate federal laws and positions on marriage. and, most likely, those federal laws will change state laws in many states after the upcmoing cases are decided. federal laws, federal treaties and SCOTUS decisions trump state laws that are in violation of those federal laws & treaties thereby nullifying those state laws.

if marriage laws weren't a federal issue, then loving wouldn't have had the impact that it did - 7 states had laws nullified as a result of that decision.

part of what factors in is states honoring marriages from other states - or, stated simply, contracts made in other states within their own borders. marriage law is at it's base, contract law. the core of the issues are those 1300+ rights delineated by the GAO a number of years ago that are extended to legally married couples.

once people understand that the base of the whole debate does not surround religious interpretations and understanding, but it rather involves public secular laws that are purposfully separate of religous law, then maybe the discussion can progress - and perhaps make some sense to those that are opposed to same sex marriage in legal terms.

any religion, any denomination, any person can hold in their hearts and minds any opinion they want with regards to same sex marriage. but it won't change the laws. just like some people may not like the fact that women can hold any job they're qualified for because their religion teaches them that women cannot teach men or be superior to them - the laws of this nation cannot be reflective of that religious tenet because not everyone are members of that particular religious sect.
