I hadn't heard about this case until I read this, but this is a major victory. State laws can no longer interfere with federally regulated benefits, even in states where a marriage isn't recognized.

I think the reasoning used was spot on. I am glad Ms. Tobits will get the benefits. But it doesn't make up for the pain she's been through losing a spouse and then having to have a court battle to make sure the law was followed.

I am a gay Christian. I also don't like to lie. I made a mistake about information in the KY lesbian story. I then posted that error on many threads. KY does NOT have a civil unions law as I claimed.

I am embarrassed that I failed to do the research I so often criticize others for not doing.

I sinned and now repent that sin. I regret this mistake deeply.

"A 1997 state law declares it a Class D felony to submit false information on a marriage license application or lie about the physical condition, including gender, of a marriage license applicant....The law also penalizes a clergyman, judge, mayor, city clerk or town clerk-treasurer who solemnizes a marriage between two people of the same gender. Those who conduct a gay marriage ceremony can be charged with a Class B misdemeanor, punishable by up to 180 days in jail and a fine of up to $1,000."
