At least the anti-gays are giving the SCOTUS numerous justifications for overturning DOMA.

Now they just have to decide which justification they want to use.

If I'm understanding Mr. Clement correctly, he's claiming that since Ms. Windsor won in a lower court, SCOTUS can't take this case! So why was an appeal allowed?

And since Mr. Clement wasn't involved in the original lawsuit, how can he now claim standing?

Convoluted is one term to use here.

Any attorney is ethically obligated to represent his client and present his case as best he can, no matter how poor the grounds or reasoning are in that case. ergo, he cannot simply just say: "You're right ! We give up."
