A Kansas man who donated sperm to a lesbian couple is being sued for child support by the state despite the couple not asking for child support from him.

This is a bizarre story ("How Bizarre !"). Why would The State Of Kansas do this, since the women don't want child support ?

Once again, folks, it's one of the flyover states. They are all grouped in a defensive treaty somewhat like NATO but without the troops. They're all sworn to keep The Gay out of their air space. However, too little, too late. Or as Kathy Griffin would put it: Tick tock...

Kansas law doesn't allow for do it yourself artificial insemination and so it doesn't recognize the agreement between the couple and the donor as being valid. Even with that being the law, this case is going to be a tough sell to pretty much any jury.

I stopped in Kansas on my way here to southern Arizona in 2011 when I moved here from New York.

Kansas seems to have an average elevation of about 11 feet, and is about 947 million square miles of WHEAT.

Even tougher is the state proving it has standing. It's one thing to help a parent get child support upon request; it's quite another to step in to private lives without being asked. One can argue that the child has a right to support from both parents, but it already has two parents supporting it.

If this weren't a gay couple, I doubt the state would give a damn.

It's a backdoor approach to prevent gay and lesbian families. Feckless I might add. They can still do the old in-out without revealing the identity of the father. All they might accomplish with this nonsense is to cause fertility clinics in Kansas to close and people to seek fertility treatment in another state. Nothing like shooting yourself in the foot. You are correct. This pointless case will go no where.

If I remember right, what started all this, is that the bio mom had lost her job before the child was born and as a result, the baby couldn't be added to her carry over health insurance; so she applied to the state for medicaid assistance for their child while she looked for a new job. This would have gone unnoticed if not for that.

It doesn't say if her partner has tried to adopt the child. Frazier v. Goudschaal says that she has parental rights, but legal adoption would make the issue irrelevant.
