Gay Parents Battle "Iowa Anomaly"

In Iowa, gay couples have been able to get legally married since 2009, when the state’s supreme court upheld a lower court ruling striking down a gay marriage ban.

But the Iowa Department of Public Health has refused to grant birth certificates that list both spouses in a gay marriage as the legal parents of newborn children. That decision has left families in legal limbo, and it led to a lawsuit that has thrust the gay rights debate right back to the state’s supreme court.

Using existing legal structures, the bioparent relinquishes all parental rights and the non-bioparent adopts. Nothing else makes legal sense.

This should apply top all hetero couples as well. This means DNA testing becomes mandatory at birth for every child.

It will be a real boon to the human genome project, and disease analysis.

It could be the best thing to happen to genetic medicine in history.

I would not - what about couples who use donors, either sperm or ova. They would not be the bio parents. In fact doctors who use donor sperm usually add the fathers sperm so they can say they really don't know.

Ummm. No. There are step parents that adopt, couples that adopt. There are egg donation, sperm donation, surrogate mothers. The parents are the ones with the legal authority. If it is a mom and a dad, two moms or two dads doesn't matter

I think your post was made to irritate others who feel that Gays have the same rights as others. I would rather see children with people who love them than with abusive ignorant ones who don't take care of their children. Love comes from many who make up ones family. The couple in Iowa are parents of the child they are raising. It doesn't make any difference regarding their sex, they have the responsibility of raising this child to become a successful citizen of the world.

We aren't in disagreement.

Let me restate.

When a mother gives birth to a child while part of a couple in which one member is not biologically related to the newborn, the unrelated member of the couple must adopt. To do this, the donating bio-parent must legally surrender all rights. The same Law applies to hetero and gay couples.

The only variant on this legal theory is that in past times, before the advent of complex genetic testing, the man married to the bio-parent at the time of birth was just assumed to be the father as long as the bio-parent mother claimed so. In past times, this was accepted without any evidence of any kind. Despite any paternity laws, this was the custom. It wasn't law. Just custom.

Now we have the means to absolutely determine both bioparents. This, AND complete gene-sequencing, should be done at birth for both mother and child.

The scientific benefits, on top of simple legal elegance, are immense and well worth the expense.
