Nice deep pocket. Might be hard to prove though.

"Emamian was herself fired in October 2008, Rowley said."

Obviously you'd want to know why this supervisor of the complaining, Jewish, gay employee was herself fired.

Obviously the company as a whole is not anti Semitic or anti lgbt - there have been lawsuits alleging racial profiling of customers - but that doesn't speak to whether you had one Iranian supervisor voicing bigoted opinions to her subordinate.

I'd bet a middling financial settlement for the fired employee even if he was funneling expensive samples to someone for re sale over the internet.

More likely he was fired for being a good for nothing scumbag.

"In Beverly ????
"I'm with the store on this one."

You don't know anything about the one supervisor, which is what the claim rests on.

You don't have to show the ownership or the entire upper management endorses a certain thing - like sexual harassment or discrimination - you only need to show a supervisor of yours engaged in improper conduct.

Both things could be true - the fired supervisor could have been making bigoted remarks and the ex employee could have been funneling samples to a particular online seller....

I thought the founding families of the store (Nieman, Marcus) were Jewish. Stanley Marcus certainly was. This from his Wikipedia entry:

"He began his university studies at Amherst College, but when traditions preventing Jews from joining clubs or fraternities drastically curtailed his social life, he transferred to Harvard University after the first year.[13] At his new school, he became a member of the historically Jewish fraternity Zeta Beta Tau, later rising to become the group's president."

And what kind of department store doesn't have gay men working for it? A failing or defunct one.

I can't imagine anyone as cheap as a jewish queer. Spending his entire life cheating and suing people for something.

Hey Barf, here is a message from a Jewish queer:

You are no more in Copenhagen than I am on Jupiter.

"I thought the founding families of the store (Nieman, Marcus) were Jewish."

What does that necessarily have to do with the fact pattern?

Human behavior. Family-originated businesses tend to reflect the culture and values of the founders even after the company is taken public, and "Samesies" don't so much discriminate against each other.

"Human behavior. Family-originated businesses tend to reflect the culture and values of the founders...."

That has nothing to do with an apparently rogue, individual supervisor. Even you can figure this out. Particularly when that rogue, individual supervisor herself got fired for some reason.

Many, many employee-employer lawsuits demonstrate this - the company cannot control individual employees all the time.

Oh jaysus, it's not a corner store.
