Kansas state officials are seeking child support from the sperm donor to a lesbian couple in exchange for the state providing the child's mother with financial aid.

Would he be taking this same action if it were a straight couple who had used a sperm bank because the male was infertile?

I'm now beginning to see why Maury Povich's show is so popular.

As you point out, a child that is the result of a one night stand is the responsibility of the biological mother and father. That's a 'traditional family value' I happen to share with even the anti-gay bigots.

It saddens me that the State is going after this man, but....we created legislatures who make the law and we created courts to interpret the law. Therefore we need to be clear as pssible when we make laws. But we don't.

The very ones who now insist gay marriage doesn't exist under Federal Law get really ticked when I point out they created it in the very law they want to defend! DOMA

Seriously hard way to learn what the law actually says. I wasn't aware that do it yourself AI nullified any agreements you might have had between the parties. He's stuck because there wasn't a doctor at the helm of that turkey baster. Ouch.

It being Kansas, of course they are going after the guy, there's no way on Earth that they would ever recognize a second parent of the same sex.

I guess it works similarly to Arizona, but it's only a guess. If your married, the husband is the legal father without a court order to the contrary. If your a single woman, straight or gay, the sperm donor can be held responsible if the mother applies for state assistance.

It's in DE and I'm not sure how they'd handle it.

That would be an excellent route for him to pursue too, as well as better for the child since he is now stuck being a part of the child's life anyway.

I'm of two minds on this. BOTH people worked together to create the child. Why should the taxpayers foot the bill if the Mother can't support the child on her own?

It seems that most men who father a child but don't want anything to do with it could have the claim that they were simply sperm donors, unless there is an appropriate legal framework at the outset.

The lesson to be learned - keep your pants zipped until you are fully familiar with the laws in your state regarding paternity and child support.

Amen to that! I had a lesbian couple who were friends for about 10 years. They asked me if I would be a donor, so they could have a child. I pondered that question for about 2 weeks, and finally decided I didn't want to have any part in it. I informed them as gently as I could, and explained my reasons. They took offense, and they haven't talked to me since. In light of this story, I'm happy I didn't do it. They broke up after about 5 years after that, and I could very well have been stuck paying for a baby's upbringing. I'm really happy I dodged that bullet. Lesson to be learned is to check out ALL the legalities before entering into such an arrangement.

I'll bet they are mad because they don't want to pay welfare benefits to lesbians. In any case, this is really dumb. The man is the biologican father but should under no circumstances be considered the legal father.

I personally don't believe that people who cannot physically have children - including gays who do not already have custody of a child - should not be bringing more into the world. But reality being what it is, actions like this would certainly deter people from sperm or ovum donation and might lead to greater use of surrogacy, which is an even slipperier legal path.

She'd probably point out to you that the relationship between a sperm donor and recipient is consensual except in cases of rape.

Wrong. One of the cases here in Florida where the Court ruled the adoption ban unconstitutional, involved a family trying to let a lesbian sibling adopt her niece or nephew.
