It's a shame that a man who is involved in an interracial marriage and who is old enough to remember Loving v. Virginia has so little empathy for another minority.

Unfortunately, it's a I've got mine rights, screw your rights attitude from Justice Thomas and others who are like him........they don't see our fight as being similar to theirs......but discrimination is still discrimination and that is what Justice Thomas should be looking at....in my opinion!!!

I suspect that Justice Thomas has some internalized guilt over his own minority status. He was born to farm workers and grew up in an impoverished community. He benefited from his own hard work, but many have assumed he got some boosts along the way due to his minority status.

This seems fairly likely since elite schools were anxious to diversify their student bodies. The fact that Thomas had the wherewithal to actually make it on his own would have made him a hot commodity, indeed.

Whether true or not, many assumed that his schooling and his career trajectory were enhanced by his minority status. He always resented having those aspersions cast his way. And that's why he adamantly opposes any form of affirmative action.

Thomas suffers from the delusion that everything he's achieved was due to his own hard work: Luck and help from others had nothing to do with his success. Like a good Randian, he opposes giving anyone else extra help (unless it arises from the luck of being born into the right family, like GWB). And he bristles at the suggestion that he got any help he didn't earn on his own.

As for his receiving opportunities because of his skin color: I've seen nothing from his work on the Supreme Court that suggests he was the most highly qualified jurist available at the time. More likely, he was the qualified, minority, conservative Republican available at the time. The ABA gave him one of the lowest "qualified" ratings of any Supreme Court Justice that they've ever rated.

The idea that he had opportunities which a similarly gifted white man lacked does not bother me: I don't doubt the many other challenges that he and his family have overcome. Nor do I think it's any worse to give a boost to members of an ethnic minority than to the families of the country's elite. But Justice Thomas can't stand the idea.

Does anyone really believe that Scalia would give Thomas permission to vote to support equal rights for the gays? Thomas probably wouldn't even bother to ask. He knows what the answer will be. Same with Scalito.

Those three are cemented in their strict adherence to 14th Century values, no matter what that stupid Constitution might say.

First off, someone would have to nudge Thom-ass to wake him up. He has said ONE sentence, on the bench, since he joined the court like almost 30 years ago. At this point, he could probably call in in by now.

And I agree with that. Many minority individuals are born with the very best opportunities. And many who wouldn't qualify as "minorities" suffer huge challenges.

But using Thomas's view, he may very well have qualified for equal opportunity treatment.

There's a extremely slim chance that Justice Scalia might vote to toss Section 3 of DOMA........but he will NEVER vote to do anything but uphold Prop 8 as Constitutional.......I mean he was one who wanted to hear the argument on Prop 8!!!
