You can't compare normal real parents to homosexual .........
Gay parents are as likely to be wonderful parents as straight folks - that's not an issue.

Why pretend otherwise? It's not like anyone with sense will believe you.

All Petitions for Cert. assert the same categories of things. It's granted if it looks like the following arguments may be valid.
This is our side's change to really slam the Marks and Regnerus pieces, and get the dirty dealings surrounding them in the official historical record. They weren't introduced in the PropH8 and Windsor Cases. Anyone who can, donate money to our Case so they have the money to do the rebuttals right.
Easier to determine are the reasons why Cert. may not be granted.
Any ideas?
Both statistically and legally the onus is on why to accept, not on why not to accept.

I am not making a comment on the various arguments for one or the other decision. Although I could.

The presumption is always that the Petition for Cert. will be granted.

But what percentage of them are granted? Based on that exactly who presumes that a given cert petition will be granted?

Are appeals of any kind expected to succeed?

What is your source for your idea?

Of course it's Judicial Discretion, but a Petition is viewed as truthful until consideration and rebuttal suggest otherwise.

Did you notice which authorities they've cited? It looks like they are hoping to get some of them mitigated.

Who said that? That any cert petition is viewed in this way?

No, there are hurdles that a cert petition must overcome, just as with granting of ordinary appeals for hearing.

What is your source? I think you are sort of making things up again.

The "heterosexuals will procreate even more irresponsibly" argument should go as well, since no single group should be legally penalized because of a different group's possible actions.

That leaves "Tradition", and that one is always on unstable ground.

Can ANYONE say that the State of Utah is trying to use the debunked Regnerus study to make their argument?

I could have probably wrote a better footnote for the State worth 2 million than that......lol!!!

From the article Rainbow Kid provided:
"And even when contravened by other evidence, they are not subject to second-guessing by the judiciary without a showing that no rational person could believe them," the state says.
http://www.sltrib.com/sltrib/blogscrimecourts...

One has to read this article with coffee and remember NOT to be at the computer......lol!!!

The comments at the end are also a hoot!!!

Keep your eyes peeled for an attempt to open the door for the SCotUS to perform something like the Gobitis reversal.
