I was watching the channel 10 news at 11:00 am Tuesday & I was surprised they showed Jim & his lawyer & they said there has been another charge against him for not claiming employee taxes, I thought he had already been charged with that at the beginning & they said his preliminary hearing will start in May.

I just went to channel 10 news san diego.com & put in update on jim kurtenbach ramona gas station owner & the article on there says the new charge is workers compensation fraud & that Joe had previously rejected Jim's request to burn down the house, but reluctantly agreed because he owed jim money. The new charge alleges jim falsified info in order to reduce payments for workers compensation premiums. He was alreaady charged with misdemeanor failure to acquire workers comp. insurance, he is being charged with 11 felonies & his preliminary hearing is set for May 27th.

EL CAJON, Calif.-- A Ramona gas station owner already charged in the fire-related death of an employee, who had allegedly agreed to burn down the defendant's Mount Woodson rental house, faces a new felony count of workers' compensation fraud, a prosecutor said.

James Anthony Kurtenbach is now charged with 11 felonies stemming from the Oct. 31 blaze that killed 24-year-old Joseph Nesheiwat and destroyed a 4,000-square-foot house on Mount Woodson Drive.

Investigators determined the blaze was intentionally set and that Nesheiwat died during commission of the crime.

The prosecution alleges that Nesheiwat had previously rejected Kurtenbach's request to burn down the house, but reluctantly agreed because he owed his boss money.

Kurtenbach was previously charged with second-degree murder, arson causing great bodily injury and arson for financial gain, among other counts.

The new charge alleges the defendant falsified information in order to reduce payments for workers' compensation premiums, Deputy District Attorney Fiona Khalil said.

He was already charged with misdemeanor failure to acquire workers' compensation insurance.

Kurtenbach's attorney has previously characterized Nesheiwat's death as a terrible accident.

Kurtenbach, who lives in Poway with his second wife, operated Stars Petroleum gas station for seven years.

County records show that he owed $16,600 in back taxes on the destroyed house at the time of the fire, according to the prosecution.

A preliminary hearing is scheduled for May 27.

I was watching channel 8 news today at 12:00 & they were talking about jim again, the property at mount woodson is being cleaned up today by county workers so that means jim isn't paying for it. He should have to pay for all of it. They were saying it has taken a while for the clean up because of the investigation. The neighbor that lives right next door was saying she finally got to go back home & she was saying it has been hard for everyone living in the area because they have to drive by the property every day to get out & it is a constant reminder of what happened & some of the kids are still having nightmeres about that night & the people that heard Joe screaming are having a hard time, they will probably never forget. I get upset again when I think about what Joe went through & what the neighbors went through. I hope jim gets what he deserves for what he has done. I don't think it's fair that jim gets to be out & be with his family & be free, he should be in prison.

I feel so sad when I think about what happened to Joe & I can imagine what the neighbors went through that night hearing him screaming. I wasn't there but it makes me cry knowing he was suffering & no one was there to help him.
