I agree Bronston man, making moonshine is just a misdemeonor,i dont know if theres a rule on how much you can make. The napiers from rockhouse alway made moonshine ,i am kin to them. I know some brays to. You are right they can only put you in jail if you have more than 5 pot plants. This is hyden ,he will walk. I remember a few years ago ,some big shots got into trouble trying to grow hemp whatever that is, it was on the tv news.

Alright, hypothetical here. Suppose you're on the job. Words comes to the station one day that "Casey", above, was overheard talking about giving her father-in-law that one quart of moonshine.
Do you go kick down her door to take that one quart of moonshine and throw her in jail?
Now, let's not get into the legalese of warrants and appealing to the judge. Just a simply yes or no question: Should the government kick down her door to prevent her from sharing that one quart of illegal substance with her family member?
Under those contions.....YES.

People should not be able to pick and choose which laws to obey and which to break.
Peace officers should not pick and choose which laws to enforce and which to ignore.

I'm really not assuming anything, you are by speculating that he'll never see the light of day again. The article clearly stated that he was charged with prescription in an improper container. It said nothing about possession of a controlled substance.
The article did not say the exact number of plants, no. But it did say a "few", and to me 6 or more would not be classified as a "few".
No I was HOPING he would never see the light of day again.

Better hush, someone might call the FBI and you'll find yourself down at the Federal Courthouse in London!
That would be the place for him. It would most likely be the ATF though.

BTW in reference to an earlier post the article said "having controlled prescription drugs not in a proper container." that would mean a controled substance.

Well no doubt, it's not a crime if you take your blood pressure medicine out of the bottle. The crime of "improper container" is only concerning controlled substances.

They found the still, 28 gallons of processed moonshine whiskey, a few marijuana plants and 13 prescription pills that were not in a pharmacy container. Sounds like this guy is going right where he needs to be. I hope they keep him there a good long time.
The man who was running this moonshine still was nearly 85 years old, so feeble the jail refued to accept him as an inmate.

The only reason it's not funny is because a poor old man now faces all kinds of charges for an activity that has been going on in Kentucky since its founding.

An activity that should not be illegal.

Ive heard all that "should be legal" crap before, and was not impressed.

It was ILLEGAL to do all of that stuff and he knew it. Jail is where he needs to be, and I hope he stays there.

Law should be just as concerned about any possesion of an illegal substance. Is it illegal to possess moonshine in any quantity?
