VICTORVILLE James Gavin was at the wrong place at the wrong time when he was shot and killed by two alleged gang members, investigators testified during a preliminary hearing on Thursday.
Homicide Detective Donald Mahoney, of the San Bernardino County Sheriff's Department, testified that Daniel Foreman, 29, and Ryan Matteson, 30, entered a Manzana Road home in Apple Valley on July 23, 2004, looking for a man named John.
Their intent, Mahoney said, was to rob this man of money and drugs. What the two suspects found instead were Gavin and two other people.
Mahoney said he learned during his investigation that Foreman entered t he bedroom of the home carrying a .22-caliber revolver.
"Foreman did the talking to the three individuals in the bedroom," Mahoney testified. "James Gavin began to run toward the open door and Foreman's gun went off."
Gavin's body was later found by emergency personnel in the front lawn of the home. A woman was shot in the arm.
"Foreman yelled,'That's for John'," as the two assailants fled the house, Mahoney testified.
Foreman and Matteson were arrested on March 9 and now face charges of murder, attempted murder, attempted robbery, burglary and being participants in a criminal street gang. The maximum penalty for these crimes is 60 years to life imprisonment.
California Highway Patrol officer Royal Johnson, a member of the gang task force, testified during the hearing that Foreman and Matteson are known members of the Vagos motorcycle gang.
Johnson said he based this on the tattoos of the suspects Foreman has a green number 22 tattoo on the back of his neck, considered to be a Vagos symbol and discussions with other members of the gang.
Johnson said the gang members were known for "insurance fraud, vehicle theft, assault with a deadly weapon and selling narcotics."---------- This is just one of many articles I will be sharing with you guys in the future. Federal and state law enforcement agents arrested 13 members of the Vagos motorcycle gang Tuesday in the San Fernando Valley, San Diego and Las Vegas, charging them with possessing stolen explosives, a cache of illegal firearms, and large amounts of methamphetamine and its ingredients.
The arrests, made in a coordinated sweep, resulted from a nearly two-year investigation into the Vagos gang headed by the Federal Bureau of Alcohol, Tobacco and Firearms. From the same investigation, five other Vagos gang members were charged in May with kidnapping, robbery, drug possession and weapons offenses, said ATF Special Agent John DAngelo.
The explosivesabout 40 pounds of commercial blasting agents believed stolen from a construction site in the Imperial Valleywere found hidden in a house just outside of San Diego, DAngelo said. About 60 machine guns, sawed-off shotguns and rifles were also found in the house, he said.
Three men in the house also had in their possession about 5 pounds of methamphetamine and 100 pounds of ingredients used to make the drug, sold to them by undercover federal agents, DAngelo said. They were charged with a variety of drug and weapons crimes, he said.
Three members from Reseda, San Fernando and Northridge were charged with illegally possessing firearms, and several in Las Vegas were accused of kidnapping, torture, extortion and racketeering, ATF officials said. More weapons-related arrests in the Valley are expected later this week, said officials of the U.S. attorneys office in Los Angeles.
ATF officials said the investigation was launched in 1997 after informants tipped them off to plans within the 200-member gang to increase criminal activities in the southwestern U.S. The Vagoswhich means vagabonds in Spanishare rivals of the Hells Angels gang, with about 25 chapters in California, Nevada, Oregon and Mexico, ATF officials said.
The scope and nature of the charges and the gun seizures speak volumes about the nature of the gang, said ATF Special Agent Richard Curd.Hopefully, our work will have a lasting and debilitating effect on them.
DAngelo said it was unclear what plans the gang had for the explosives and weapons in San Diego.
Its not uncommon with these types of organizations where they find they need to arm themselves in such a way for protection, he said.
The Vagos are so wary of rival gangs and law enforcement agents that they allegedly kidnapped and tortured a man in Corona whom they suspected of stealing from them, ATF officials said. Several members beat the man for hours, trying to get him to confess to spying on behalf of another gang or federal agents, according to the agency.
They were trying to intimidate him, DAngelo said.
Into that atmosphere jumped one undercover federal agent whose mission was to document the crimes committed by Vagos gang members in the Los Angeles area, DAngelo said.
Posing as a prospective member, the agent joined gang members at parties and meetings earlier this year, hoping to become initiated into the gang. As part of the initiation, he had to buy beer for the gang, work as a bodyguard at parties and guard members motorcycles while they met with members from other states, DAngelo said.
The agent was eventually turned down for membership after the Vagos hired a private investigator and did not like what was discovered, DAngelo said.
They did not feel comfortable with him, DAngelo said, declining to elaborate.They are very organized about backgrounding people. We pulled our agent out for his own safety.

You and I do not agree on any level! The club is not a gang and Jeri says what she says in an effort to support her son and defend the club against the never ending stream of fabrications coming from the law enforcement side of the argument.
My disagreement with her stems from her trying to claim that damage has been done to her through no fault of her own. She has made serious errors in judgment based on her lack of experience with the internet. She was unaware of type of trash that follow people that make these mistakes around harassing them.
Truth and justice is an interesting handle since you obviously stand for neither. You people have an agenda that you will never admit to and that is to eliminate motorcycle clubs from the face of the earth. You can't stand that we are free to do as we please...Because we are different from you!
You hate that we are protected from your lies and persecution by the Constitution of the United States! You people are so desperate to have everyone adhere to you pathetic little whitebread lifestyle that you harass and attempt to intimidate anyone that doesn't.
People like you are gradually turning this formerly free republic into a locked down socialist state with very limited individual freedoms. Hiding behind and envoking the Constitution, what a typical gang member response and you're proportitly the sharpest knife here? This is going to be an easy debate to win. Let's set the record straight on a few things. 1> Darby nor his friend ever harrassed or stalked Jeri. They gave her back what she and others have been dishing out for over two years. It's not that hard to defeat the wrong and mentally deficient. It gets boring after awhile and people just get tired of showing what total morans you all are. It's like watching a fat person run, at first it's funny. Then it's sad. 2> Jeri threatened Darby and others here on this post. She has praised the gang that her son was convicted of murdering for on this post. Then what did she do when confronted with her behavior and getting it back as she gave so many timses here? She cried victim and complained to topix. This is funny on so many levels. Plus it shows her true colors. It's a fact that most criminals snitch when trying to get away. We bank on that. Department of Justice Investigation into Vagos Motorcycle Gang Results in 26 Arrests And Seizure of Drugs, Guns and Cash
(SACRAMENTO) A California Department of JusCtice (DOJ) investigation into alleged gang and drug trafficking activities of several members of the Vagos Motorcycle Club has resulted in the arrests of 26 people and the seizure of more than $127,000 in cash and illegal drugs and guns, including three assault weapons. The investigation is ongoing.
Since the investigation began in April 2004, DOJ firearms and narcotics agents and officers, assisted by officers from other state and local law enforcement agencies, served 26 search warrants and conducted three probation searches. As a result of the investigation, 25 adults and one minor were arrested for various drug-related charges, including conspiracy to distribute methamphetamine and conspiracy to distribute steroids. Of those arrested, four confirmed members of the Vagos Club also were charged with smuggling steroids into the United States from Mexico.
Information developed during the investigation led to the arrest by Sacramento County Sheriff's deputies of Richard Gama, 37, of West Sacramento. Gama faces charges involving the homicide of Edward J. Bustillos, 42, in Rio Linda on August 12, 2003.
Seized during the investigation were more than 100 pounds of marijuana, valued at $500,000; more than one pound of methamphetamine, valued at $12,000; 250 tablets of Vicodin, valued at $625; 250 tablets of Oxycodin, valued at $625; and steroids valued at $5,000.
In addition, the following items were seized during the searches and pursuant to asset forfeiture proceedings: 18 handguns, including six that were stolen; three assault weapons, including one that was stolen; five shotguns, including one illegal sawed-off shotgun; eight rifles; more than $127,000 in cash; 13 Harley Davidson motorcycles, including five that were stolen; nine vehicles, including two Hummer H2s; two boats; and a motor home.

In July 2004, Investigators with the California Department of Justice, Firearms Division; CA DOJ, Bureau of Narcotic Enforcement; California Highway Patrol; Placer County Sheriffâs Department; Sacramento Sheriffs Department, Sacramento CAL-MMET, and the Sacramento County District Attorneys Office, conducted an investigation dubbed Operation Dos Verde, which involved members of the Vagos Outlaw Motorcycle Gang (OMG).
During the investigation it was learned that James CROSS, the President of the Placer County Chapter of the Vagos OMG as well as two other Vagos OMG members, Ryan HILL and Nicholas MATTESTON, intended to murder fellow Vagos OMG member Jason JORDAN. This murder was going to be conducted in order to obtain JORDANâS assets derived from the illegal sales of methamphetamine as well as for JORDANâS cache of firearms. It was also learned during the investigation that after the murder of JORDAN, CROSS, HILL and MATTESON were going to leave Vagos OMG and join the Hells Angels OMG.
During the course of this investigation, CROSS supplied 2 handguns to be used in the murder of JORDAN and an assault weapon was supplied by CROSS and HILL for pre-payment to commit the murder of JORDAN.
On October 14, 2004, as a result of this investigation, several search and arrest warrants were authorized and served, resulting in the arrest of CROSS, HILL and MATTESTON for conspiring to murder JORDAN and the seizure of the following:
4 arrests-all validated Vagos OMG members
4 grams of methamphetamine ice
$80,000.00 in United States currency
4 Harley Davidson Motorcycles (2 of which were stolen)
8 firearms â which include one assault weapon and two stolen handguns
As a result of the aforementioned case, a year long investigation dubbed âOperation Black Pearlâ was conducted into the criminal activities of the intended murder victim Jason JORDAN and his associates.
Operation Black Pearl was conducted by Detectives with the Sacramento County Sheriffâs Department, Sacramento CAL-MMET, Special Agents with the California Department of Justice, Firearms Division and Bureau of Narcotic Enforcement along with the Sacramento County District Attorneyâs Office.
During this investigation it was determined that JORDAN, now the president of the Sacramento Chapter of the Vagos OMG, was using other Vagos OMG members and associates to distribute methamphetamine and obtain illegal firearms.
On November 8, 2005, 11 search warrants as well as numerous arrest warrants were served throughout the Sacramento area resulting in the arrest of the following people for varying charges including; conspiracy, participating in a criminal street gang, and narcotic and weapons violations and money laundering.

Based upon evidence and information uncovered during this investigation, a methamphetamine source of supply was revealed and investigators were able secure search warrants for this secondary drug trafficking organization.
On January 9, 2006, detectives with the Sacramento County Sheriffâs Department, Sacramento CAL-MMET and Special Agents with the California Department of Justice, Firearms Division, served two additional search warrants on the business and residence of Vagos OMG associate Robert MURRAY.
A search of MURRAYâs business, identified as Murrayâs Auto Body and Paint, and MURRAYâS residence, resulted in the seizure of 15 lbs of methamphetamine ice, 7 firearms and the arrest of 2 individuals.
On January 9, 2006, a follow-up investigation by detectives with the Sacramento County Sheriffâs Department along with the Sacramento CAL-MMET team resulted in the seizure of an additional 15 pounds of methamphetamine and the arrest of 2 more individuals.
TOTALS FOR BOTH INVESTIGATIONS:
25 arrests which included 9 validated Vagos OMG members
Over 30 pounds of methamphetamine ice
$ 93,298.00 in United States Currency
75 firearms â Which included 7 unregistered assault weapons and 5 stolen firearms
20,000 rounds of ammunition and several high capacity magazines
7 Harley Davidson motorcycles, 2 vehicles seized â 2 of which were stolen

I think it is funny that you think Bikers are ALL Bad.
I have seen and lived with both sides. My father was a cop and so was 2 of my uncles. And they were Good cop's. But on the other hand I saw Bad cops sell drugs, place guns and drugs where they were non to prosecute someone. I personally had a cop abduct me a gun point and rape me. They did nothing to him, because I road a Motorcycle. And at that time my bike was a Honda.
I have also dated 1% Bikers and was always treated with respect and as a lady.I do not do drugs, and I have one drink every few months.
I see many 1% bikers defend our freedom and our rights. They do supportive things for the community. Family means a great deal to them.
Bikers are not the only groups playing both side of the good and the bad. There are many types of gangs out there. I have never seen a Gang, do anything good for the community. I am referring to all the gangs that are out there that have nothing to do with motorcycles. They do not fight for our freedom, or protect our rights. They do not support girl's and boy's clubs.They have no sense of brotherhood. All they do is Bad Negative things. Go after them as much as you are going after Bikers. How often do you read about a bad cop being caught. Not much and I know first hand there is a lot of them out there.
Respect that there are many point's. Not just one.

I am a Mom and I love my Son, I do not agree with all the directions or choices he makes all the time. So at times I may not like him much, but he is my Son and I will always love him.
