Defense in Sept. 11 case seeks 'black site' access

Lawyers for an alleged Sept. 11 plotter held at Guantanamo want to inspect secret CIA overseas prisons, saying in court papers Monday the conditions in the so-called black sites may yield insight into a mental disorder that has raised questions about whether he is competent to stand trial.

The case against Binalshibh includes conspiracy and murder charges for purportedly helping find flight schools for the Sept. 11 hijackers, and allegedly providing other assistance. He allegedly was selected to be a hijacker and made a "martyr video" in preparation for the operation, but was unable to get a U.S. visa.

Binalshibh, who has said he wants to serve as his own attorney and plead guilty, said at a January hearing that he was proud of his role in the Sept. 11 attack.

La Liga Antidifamación de EEUU consideró "hipócrita" la decisión de un juez español de investigar si altos funcionarios de Jerusalem cometieron un crimen de lesa la humanidad por el ataque en 2002 contra un jefe terrorista del movimiento fundamentalista islámico Hamás, en el que murieron catorce personas y hubo numerosos heridos.

"La decisión de España de lanzar esta investigación alcanza nuevos niveles de hipocresía y es un insulto al Estado de Israel", consideró el director de la Liga Antidifamación (ADL, por sus siglas en inglés), Abraham Foxman.

Foxman dijo que "dado el vergonzoso historial de su propia judicatura, España no está en posición de destacarse a sí misma como un ejemplo sobre terror y ley. Hubiera sido mejor que tratara de abordar sus mayúsculas deficiencias en vez de empañar la independencia y alta respetabilidad de la judicatura de Israel".

El juez Fernando Andreu, de la Audiencia Nacional española, ha admitido a trámite la querella interpuesta por el Centro Palestino para los Derechos Humanos (PCHR, por sus siglas en inglés) por el lanzamiento de una bomba el 22 de julio de 2002 por un avión de combate la vivienda de Salah Shehade, destacado dirigente de Hamas, responsable del asesinato de numerosos civiles israelíes.

La citada organización, fundada en 1913 y que lucha contra el antisemitismo, los prejuicios y la intolerancia, indicó varios ejemplos de lo que calificó como "serias deficiencias del sistema legal español".

Entre ellos nombra que "en enero de 2009, un juez del Tribunal Supremo español ordenó la puesta en libertad de Imad Eddin Barakat Yarkas (Abu Dadá), un terrorista de Al Qaeda convicto de ayudar a financiar los ataques del 11 de septiembre" de 2001 contra EEUU.

Agrega que "en noviembre de 2008 la fiscalía española y el Tribunal Supremo interrumpieron una investigación sobre los asesinatos de más de 100.000 de sus propios compatriotas durante la dictadura de (Francisco) Franco".

También incluye en esa lista de "deficiencias" que la fiscalía española "fracasara en obtener la condena de Rabei Osman Sayed Ahmed, el supuesto cerebro de los ataques de 2004 contra los trenes de Madrid y que él mismo se declaró como la "amenaza" detrás del complot de Madrid".

Foxman consideró que "la investigación de España exacerbará la demonización de Israel que es común en la prensa española y que en las últimas semanas se ha intensificado con manifestaciones anti-israelíes en ese país".

La ADL agrega que el Gobierno de Jerusalem nombró un grupo independiente para investigar el asesinato de Shehade, que concluyó que "no procedía una investigación de ese tipo. En diciembre de 2008, en una decisión que había cuestionado la conclusión de ese grupo, el Tribunal Supremo de Justicia de Jerusalem determinó que no había base para una impugnación".
