You didn't link to the case, you linked to a biased op-ed about the case.
Also, Scalia wasn't on the court in 1971, so there is no summary of his in the case for me to read.
He has since expressed his displeasure with the Lemon test, as he is displeased with nearly every attempt to enforce the Establishment clause.
I expect this has something to do with the free jet rides he gets from Jay Sekulow, but that's another story. Theirs is a minority opinion not adopted by the SCOTUS.
Admit it, you name-dropped Lemon because you saw it in some crazy right-wing screed but you actually know next to nothing about the case. I even linked you directly to the court's opinion.

Scalia does not like the Lemon Law Test as well as another judge does not like the one that they like to throw around being won.
The argument was judges do not like it, simple as that. It is a shtty way to decide these cases they know it, so should everyone else.

It is not called the "Lemon Law Test." It is called the Lemon Test. Lemon Laws are about used cars. Sheesh. You got yourself.
Judges do like it, and others do not, and that itself is not any kind of argument at all. No shit sherlock. Some people like blue, others like red. I asked YOU what YOUR problems with the Lemon Test were, and you obviously do not know enough about the law to even articulate an answer.
So tell us, counselor, exactly WHY IN YOUR OWN WORDS is the Lemon Test so "shitty."
