Simple. Kurt didn't get penalized because:

A: If he didn't have his helmet on, how could he hear anyone say "stop"

B: Dale Earnhardt Sr. did virtually the exact same thing in 1997.

I think if Kurt Busch not wearing his helmet came back to bite him, he woud've got the most unfortunate penalty you could get. Dale Sr's incident happened before Nascar really started emphasizing safety of the drivers. Apparently Nascar is not as strict on safety as the company I work for

I dont really.believe Kurt's story but he is getting better. Still some issues.
