I have known Jimmy and his family for years, if the Nascar world really understood how crazy this guy is and his family, they would push him back to the junkyard.
If you are ever in central Pa, go to his families junk yard in Shickshinny. Here is their latest idiotic thing:
SALEM TWP.— Ed and Frances Spencer are piling junk cars and other debris from their salvage yard on their neighbors' property, two lawsuits say.
Don and Joanne Bower are suing the Spencers for allegedly storing the vehicles, chopping down trees, tearing up grass, and burning tires on their land.
The Bowers' attorney says the Spencers then scraped the topsoil from the Bowers' land and offered it for sale, plus blocked their driveway with more junk vehicles.
Paragon Produce, owner of the 6Ls vegetable packing plant, also filed a lawsuit in 2005 against the Spencers, claiming they spread their salvage yard onto plant property. That lawsuit was settled, and now the company is selling the approximately 16.5-acre parcel to the couple, a 6Ls representative said.
But the Bowers' case is likely to go to trial this year, said the Bowers' attorney, Donald Karpowich.
"(Ed Spencer) is just trying to take my client's land without paying," Karpowich said. "My client is a man of integrity and principles, and he's not going to let that happen."
Spencers claim squatter's rights
The Bowers own more than 300 acres on the west side of Route 11, across from the Spencers' scrap yard. The couple plans to develop it, the attorney said.
Some time after 2000, the Spencers began moving junk and junk vehicles to the property, according to the lawsuit in Luzerne County Court.
Then, in 2004, the Spencers filed paperwork to claim the property through squatter's rights, Karpowich said. Under those rights, people who have used land as if it is their own for 21 years without being challenged can sometimes be awarded title to the property.
"Sometimes people use that to claim 30 or 40 feet, maybe after they planted a garden there," Karpowich said. "He wants nine acres."
Bower had much stronger words for the Spencers in a letter he sent to the Spencers before filing his lawsuit.
"I am appalled at the action you are barbarously trying to pursue," he wrote Mr. Spencer in a letter he sent in 2006.
In that same letter, he told the Spencers to remove all their junk parts and vehicles from his land.
After that, the Spencers began using even more of the Bowers' property, piling junk within 75 feet of a house, the lawsuit says.
They also started blocking the driveway on the Bowers' land with additional junk vehicles in an effort to keep the Bowers from entering, Karpowich said.
That piece of land wasn't part of the property the Spencers were claiming, and a court ordered the Spencers to clear it, he said.
The Spencers obeyed, but in the process, they also cut down several mature trees and dug up the topsoil, which they offered for sale, Karpowich said. They claimed at the time that they needed to cut down the trees to remove the cars, but Karpowich said there was plenty of room.
"It was just a lot of vindictiveness," he said.
In addition to the junk still piled on part of their land, the Bowers worry about burn piles the Spencers left, plus the possibility of leaking fluids from the junked vehicles, he said.
The lawsuit doesn't specify how much money the Bowers are asking the Spencers to pay, but Karpowich said the damage to the land is in the hundreds of thousands of dollars.
The Spencers did not respond to repeated requests for comment.
