people forget a few years ago that Jeff Gorden could finish anywhere but last and Hendrick entered another car and had it to come out after only a lap or 2. why did nascar not do anything then

Simply because it wasn't again the rules at that time. In essence, they didn't change the outcome of the race. But now NASCAR probably would step on someone doing that.
