No One really knows for SURE what happened with this case. You are all quick to judge and say Tony did this and Tony did that. Only problem with that is, none of you really know if Stewart even saw the kid out in the middle of a live race track on foot or not. He may have seen him at the last second, in which at that time it was all but too late. Go Back to the video and watch it carefully with an open and un-biased mind. If you do that then keep in mind all of these things and watch for them:
1.) It's a dirt track. A wet and and dark colored dirt track.
2.) Dirt tracks are not easy to drive on, specially when wet.
3.) It's night time and the track is very dimly lit.
4.) Kevin Ward was wearing an almost all black uniform.
5.) 2 other cars before Stewart almost took out this kid. Specially the #45.
6.) Yes Stewart has been mad at races before in the past, but in this one what reason did he have to be mad ? He didn't get wrecked or get any damages to his car. So why would he be mad at all ? He wouldn't.
7.) Also try to remember that Peripheral Vision is very limited in all race cars. You have roll cages, netting, safety devices to restrain your head from moving too much from side to side, and a full face helmet.
8.) Everyone brings up the revving engine sound heard on the video. From the one video that there is of this incident, it is very hard to tell which car revved up. But contact between Stewart's car and Ward are already happening when the motor rev is heard. So this could have been another car speeding back up that is out of frame, or IF it was Stewart's car, could it be that he hit the gas out of being paniced and/or startled ? It is also safe to say that punching the gas would help turn the car quicker and since his back end kicked out to the left then that would mean that he was trying to get away from Ward.
9.) Why in the world would anyone run up and down a racetrack that has live cars driving on it ? Kevin Ward Jr. ran thru several lanes of traffic her which I'm sorry, but that was stupid. He took his own life into his own hands upon making that move.
10.) The safety crews had not arrived at the accident scene yet. So Ward should have not been out of his car yet. Plain and simple. Had he stayed in his car at least until the safety crews arrived to shed some light on everything, then none of this would have happened.
11.) Why doesn't anyone question the fact the officials at this track left the race on a yellow flag ? As soon as officials saw that Ward was out on the track like that it should have went to an immediate RED flag. Maybe the officials at this track didn't see Ward out there running around either ?
There are several things that can be blamed here. Not just Tony Stewart. Poorly lit track, a loose and slick racing surface, a darkened racing surface, no RED flag, slow response by safety crew workers. Then there's the FACT that Ward should have NEVER been out in the middle of a live track to start with. By pointing at Stewart and trying to put all of the blame on him, this lets poor quality and the slow services of the race track and it's officials off the hook. It also lets Kevin Ward Jr. completely off the hook for his actions as well.
The Bottom Line here is, Had Ward stayed in his car, he would be alive and well today.

If tony wanted to hit him why didnt he hit him with any part of front end. He was throttling to go by....
