Squatters want land they have lived on for 50 years
By PRIYA MENON
THE government and the mayor of Kuala Lumpur are facing lawsuits from Sg Besi squatters.
A total of 20 residents of Kampung Pakar, near Taman Sg Besi, are asking for their rights to own the land they have lived on for more than 50 years.
The residents live on two pieces of land, one that is owned by the Kuala Lumpur City Hall (DBKL) and the other owned by the third defendant, Daya Impian Sdn Bhd. The company procured the land from DBKL in 1993 and since then have started developing a part of it as an industrial area.
“It is not fair that DBKL sold the land to the company and not tell us,” said Chong Thiam Loy, a resident of the place.
Residents of a nearby settlement were given titles to the land they lived on and the residents of Kampung Pakar are wondering why they have not been given a similar opportunity.
“We have not been treated fairly and we want them to give us a proper explanation and reasonable compensation as well,” Chong added.
DBKL issued notices to the 80 families in Kampung Pakar in April to relocate to the Kampung Muhibbah flats located nearby in order to develop the area.
As compensation, the residents are only receiving RM3,000 to RM6,000 to evacuate the land.
“They plan to sell each acre for six million ringgit and for 15 years they have collected a rental of RM20mil from the industrial area,” said Banie Chin, the MCA Seputeh Division vice-chairman.
Banie said the company planned to divide the land so their profit from that alone would be RM60mil.
“It is unfair that the people get such a small amount compared with what the (defendant) will be earning,” he added.
To top it all off, the residents have been asked to move out within the next two months and it is said that thugs and gangsters have been enlisted to prompt the residents to move.
“We have made a police complaint after their visit but this has not stopped them from coming back,” Banie said.
Chong said it was not the residents intention to fight the government but they were merely asking for what was rightfully theirs.
The residents with the help of MCA Seputeh Division have enlisted the help of lawyers and they served all three defendants with notices and a statement of claim on July 14.
A DBKL representative said City Hall would leave the issue to the court to decide.

‘Loan sharks forced my girl into vice’
KUALA LUMPUR: A mother has claimed that her daughter was forced into prostitution by loan sharks after her boyfriend failed to settle his debts.
“I didn’t know that my daughter signed as her 32-year-old boyfriend’s guarantor until loan sharks came in four cars a month ago and on a motorcycle the following day to ask me to settle the debt,” said Tan Yew Ying, 40, who resides in Ampang here.
“They were looking for my daughter to negotiate payment of the debt.”
Tan claimed that her daughter, Chung Vee Ying, 19, the oldest of three siblings, is now confined by loan sharks to a room in Skudai, Johor Baru.
One of Tan’s friend, who happened to be Chung’s customer, told her about it. Initially, Tan didn’t believe him.
On March 30 this year, Chung and her boyfriend were detained over a drug offence but she was bailed out by a friend.
Chung tried to bail out her boyfriend, Lam Then Mun, but was unable to do so. He was released 14 days later.
“The loan sharks asked me to pay RM5,000 to settle the debt but I didn’t have any money. I last saw my daughter during Chinese New Year, After March 30, she hid from me,” said Tan.
She said her daughter has been staying with Lam, a former air conditioner technician, since she was 14 years old. She dropped out of school when she was in Form 3.
“In her last phone call to me on April 13, she told me that the loan sharks had confined her to a room.
“Chung also told me that hopefully, by the end of this year, she would be able to settle all the debts.”
On April 19, Lam and Tan sought help from MCA Public Services and Complaint Department head Datuk Michael Chong after filing a police report at the Ampang Jaya police station.
“Lam told me that if I really love my daughter, I should save her from the loan sharks. That’s why I came to see Datuk Chong,” said Tan.
Chong said yesterday, Lam had claimed that the money borrowed was for Chung to live up to her mother’s demand for household expenses, which was about RM800 per week.
When Chong questioned Tan on this, she refused to say anything.
However, yesterday, Tan revealed her side of the story to Chong.
“He threatened to slap me in front of you (Chong) twice if I dared to deny the statement,” said Tan, adding that the money was borrowed by Lam.
“He told me that he owed the loan sharks RM60,000.”
Lam was supposed to attend the Press conference yesterday but he did not show up.
Chung’s uncle, who only wanted to be known as Lim, said that his niece called him up two nights ago.
“She told me not to force her (to leave the loan sharks) otherwise she would commit suicide. She pleaded with me and asked me not to publicise the matter. She is determined to handle the matter herself. She also said that the loan sharks would do something nasty to her if her mother reported to the police,” said Lim.
Chong said:“I want to tell the loan sharks to release the girl because she is only 19. She is only a guarantor. If you want the money, go after Lam.”
Chong said if the girl is not released, her photograph will be displayed in newspapers so that the public can help locate her.
He added that he will work with the police to settle this case.

Syndicate the worst Chong has seen in his decades of work
PETALING JAYA: Datuk Michael Chong came to know about the syndicate that “kidnaps” loan defaulters three months ago but was forced to keep silent as police were carrying out investigations.
The MCA Public Services and Complaints Department head said that in his decades of service helping people in Ah Long matters, what the syndicate did to their victims – kidnapping them, chaining and feeding them scraps – was the worst he had ever seen.
“I am appalled at the lengths one can go to hurt another just for the sake of money,” Chong said yesterday.
He first came across such a case when a Chinese national woman pleaded with him to help her find her missing Malaysian husband.
Chong, who had thought it was a missing person’s case at first, later found out that the husband had been locked away for more than 10 days and was only released after the “ransom”, which was the loan money, was paid up by the wife.
He then alerted the police about the “sadistic” Ah Long syndicate.
“The next case with an identical modus operandi came to me about two months ago. A young man was badly beaten up and had pleaded to his family for his life.
“At this point, I realised that something really bad was going on and quickly informed the Selangor and Kuala Lumpur police about the existence of such a syndicate, which kidnaps its victims who do not pay up their loans,” Chong said.
However, Chong was told to “lie low” as police were investigating the case.
Six weeks ago, he was approached by the family of a woman who had been taken, chained and beaten up badly. The family was told that she would not be released until they paid up her loan. She was released after a week.
Two weeks ago, he found out that a woman in her 40s had been kidnapped. She was stripped from waist down and caned on her buttocks.
“The Ah Long captured the beatings in their camera phone and sent an MMS to the woman’s family, ordering them to pay up or more punishment would be meted out on the woman.
“Again, I was urged to stay calm by my friends in the police force who told me they were close to cracking the case,” Chong said.
He was relieved to know the syndicate had been busted and paid tribute to the Selangor police and Kuala Lumpur police over the success.
“Some of the families told me they would get calls from the syndicate, who made them listen to their loved ones shout and cry for help as they were beaten up,” he said.

Doctor Charged With Duping NRD Over Babies' Birth Registration
JOHOR BAHARU, June 16 (Bernama)-- A doctor on Monday pleaded not guilty to four charges of cheating the National Registration Department (NRD) and another four for falsifying documents involving the birth registration of four babies.
Dr Robert Luk Tai Kong, 62, a Malaysian now residing in Singapore, appeared calm and to have understood the charges read separately to him in the Sessions Court here.
The court allowed the doctor to be on a RM80,000 bail with one surety and fixed Aug 25 for mention of all the cases. He was also ordered to report to the Central Johor Baharu police station in the first of each month.
In the first charge under Section 417 of the Penal Code read before judge Muhammad Jamil Hussin, Dr Luk is alleged to have deceived Johor NRD staff Nayagie Kumarusamy to issue a birth certificate for baby Fabian Naveen with the names of his real parents given as Cynthia Darshan Singh and Ferliex Stanislaus.
The offence is alleged to have been committed at 11.43am on Oct 25 last year at the Landmark Medical Centre, Menara Landmark, here.
In the three other charges read to him before judge Aliman Musri, Dr Luk was charged with falsely giving the names of So Sai Hong and Loong Cher Heng; Kogula Sundari Periasamy and Thiagarajan Nadarajan; and Evensia Mary D. Stanislaus and Gerard Joseph as the real parents of babies Loong Yu Xuan, Rubhashri Thiagarajan and Serena Swathi respectively.
The details given had deceived Nayagie and two other NRD staff, Suriyani Mohamad Noor and Sh. Ramdzan Sh. Abdullah, into issuing birth certificates for the three babies at 10.23am on Oct 8 2007, 10.50am on Nov 23 2006 and 3.34pm on Feb 26, 2008 respectively at the same place.
On the first charge under Section 471 of the Penal Code, Dr Luk is alleged to have at the same time and place, unlawfully used as genuine a birth certificate form for baby Fabian with Cynthia Darshan Singh and Ferliex Stanislaus stated as his real parents although he had reason to believe that the document was false.
He also faces the same charges involving the three other babies and respective three sets of parents.
Luk can be jailed for up to five years or fined, or both, if convicted for each charge under Section 417, and up to two years' jail or fined, or both, for each charge under Section 471.
DPP Idham Abdul Ghani prosecuted while Dr Luk was represented by counsel R.K. Menon.

Violated by Ah Long mob
By ROYCE CHEAH
KUALA LUMPUR: A 51-year-old woman was overpowered by three men near her office, who took turns to stick their middle finger into her vagina. That was, however, only the beginning of her harrowing ordeal.
“The loan sharks took a bunch of joss sticks, lit it and started burning my arms and thighs. They wanted to burn my private part too, but only managed to burn some pubic hair as I begged them to stop. They also burnt hell money and poured kerosene over me in an attempt to burn me. I was just lucky that I was not burned to death.”
The woman who only wanted to be known as Tan was speaking at the MCA Public Services and Complaints department yesterday. Department chief Datuk Michael Chong described her run-in with loan sharks as the “worst” he'd come across.
The incident took place on March 31 at a stairwell near Tan's isolated fifth-floor office in Cheras. She said it was because the loan sharks wanted more money even after she had paid them what was owed.
Tan said her screams for help went unheard during her 30-minute ordeal and that she passed out a few times due to the pain that was inflicted.
She said the men had put on surgical gloves before sticking their finger into her vagina and that they were laughing at her while carrying out the obscene act.
“It was only two hours later when I was conscious enough that I called the police to lodge a report and to be taken to hospital.”
Chong said Tan, was a repeat “offender”, as she would constantly go to loan sharks to borrow money.
“She has sought help three times. She was here in November last year, February this year and it was only during her latest visit here on May 29 that I found out about what had happened to her in March.”
Tan said she recognised one of the loan sharks who had tortured her.
Chong said the case was now being handled by the Federal Police Sexual Abuse and Child Investigation Division (D11). He also advised women to stop borrowing money from loan sharks.
“This could happen to anyone, because loan sharks have no heart,” he said.

Two ‘slave workers’ paid RM36,000 by factory
KUCHING: Two brothers, who were virtually slaves at a factory in Puchong in Selangor for 15 years, have been compensated.
Simon, 30, and Radin Bangan, 31, accepted RM36,000 in total compensation from their former employer after mediation by officers of the Labour Office in Subang Jaya last month.
“An amicable settlement was reached whereby the two brothers who were represented by a legal counsel, agreed to accept the offer of RM36,000 in total from their employer, a ‘pau’-making factory.
“The money was paid to them through their counsel and the case is closed,” said State Labour Department assistant director August Buma in a press statement yesterday.
He said the case was dealt with under the provisions of the Employment Act 1955 by the Selangor Labour Department.
Arising from this case, the State Labour Department advises locals working outside the state to first contact and consult officers of the department before accepting any job offers.
This is to enable the department to verify the authenticity of the job offer to prevent job seekers from being cheated by unscrupulous employment agents and recruiters.
The two brothers from Kampung Antayan, Kropok, an Iban village in Serian, had claimed they had laboured 12 hours daily, seven days a week without pay for 15 years.
They were promised a salary of RM2,000 each by an agent in Kuching but never got a single sen.
They were allowed to return home last February when they threatened to quit.
Aside from them, the brothers claimed there were also five other workers comprising two Bidayuhs from Sarawak and three Chinese from Perak, who were allegedly forced to work at the factory.
