The young man got off because the District Attorney's office failed to indict on all of the charges available to them. Felony murder. What about reckless endangerment with a firearm?
One example of reckless endangerment could be firing a weapon out the sunroof of a car. The person firing the weapon would be aware that there is a chance that someone could be hit with a bullet, potentially putting people in the area in danger. If someone is injured or killed, the person can be charged with a reckless endangerment felony, because the use of a deadly weapon such as a gun in a reckless endangerment case upgrades the charge to a felony.. I am not sure of the site name but it is under the penal code of the state of Texas Chapter 6 sec 6.03
